340 Novembr Court 1719 Whereupon at the Prayer of the Plt by his afd Attry the Said Deft is adjudged to give Special baile to the afd Accõn And that the Sherf of Kent County keep the Said Deft in Safe Custody untill he Shall give Special bayle as afd. Thereupon Nathaniel Pearce of Kent County Gent present here in Court undertakes for the Said Joseph Wood that in Case the Said William Spearman Administrator of the afd Michael Gaughagan Shall recover Judgment in the Plea afd against the Said Joseph Wood or that he the Said Joseph Wood Shall be therein Convict that then he the Said Joseph Wood Shall pay the Condemnation of the Court thereupon or render his body to the Custody of the Sherf of Kent County in Satisfaccõn thereof or that Nathaniel Pearce will do it for him And now at this Court to wit the 19th day of November Anno Domi 1719 the afd Deft here present in his proper person comes and defends the force and injury when &ca. and Says that he cannot gainsay the Plt his Accõn afd So as afd against him brought nor can he Say but that the Said Plt ought to Recover his Debt afd and Costs of Suite against him which the Said Plt does not gainsay Therefore it is Considered by the Justices here the 19th day of November Anno Domi 1719 afd That the Said William Spearman Administrator of the afd Michael Gaughagan recover against the Said Joseph Wood as well the Sume of Two Thousand four hundred pounds of Tobacco his Debt afd in forme afd Confessed as also the Sume of Three hundred and five pounds of Tobacco by the Court here adjudged to him for his Costs and Charges by him about his Suite in this behalfe laid out and ex= =pended and the Deft in mercy &ca Jams Smith Clk
