Novembr Court 1719 339 a declaration with the writ in the Said Accõn wherein the Sherf of Kent County to whom the writ in the Same Accon was directed makes return thereof to the Court here on the third Tuesday in Novembr. to wit the 17th day of the Same month Anno Domi 1719 being the day of return of Said writ Endorst Cepi Corpus Copy Decln Served in time pr Simon Wilmer Sher and the Decln as afd folls vizt Kent County in Maryland Ss Joseph Wood of Kent County Planter als Dicts Joseph Wood of Kent County and — province afforesaid Planter was Summoned to Answer unto William Spearman Administrator of all the Goods and Chattells Rights and Credits which were of Michall Gaughagan who died Intestate as tis Said of a plea that he render unto him the full Sume & Just debt of two thousand four hundred pounds of good Sound Merchantable Leafe Tobackco in Casque to Contain ye Same Clear from all manner of trash and Ground — Leaves of the value of twenty four pounds Sterling money which from him he unjustly detains &ca. And Whereupon the afd Plt by David Macbride his attry Sayth that whereas the afd Deft vizt. the fourth day of March in the year of our Lord Christ one Thousand Seven hundred and eighteen at Shrewsbery Parish in Kent County & within the Jurisdiciõn of this Court by his Certain writing obligatory which he the Said Deft Sealed with his Seale and as his deed delivered here into Court brought whose date is the Same day and Year above mentioned bound himselfe his heirs Exrs. and Admrs. in the full Sume & Just debt of two Thousand four hundred pounds of good Sound Merchantable leafe Tobackco in Casque to Contain ye Same Clear of all manner of trash and Ground Leaves of the afd value of twenty four pounds Sterling money to be paid to the afd Michael Gaughagan his heirs Exrs. Administrators or Lawfull attry when thereunto afterwards he Should be required Nevertheless the afd Deft the afd full Sume & Just debt of two thousand four hundred pounds of good — Sound Merchantable leafe Tobacco in Casque to Containe the Same Clear of all manner of trash and Ground Leaves of the afd value of twenty — four pounds Sterling money to the afd Michael Gaughagan in his life — time nor to the afd William Spearman Since the death of the afd Michael Gaughagan vizt. the Seventeenth day of June in the Year of our Lord Christ one Thousand Seven hundred and Nineteen & often afterwards at the Parish County and Jurisdiciõn afd he the Said Deft hath not rendered nor paid but that to the Said Plt to render or pay hitherto hath denyed and Still doth deny and unjustly detains to the damage of the Said Pltf fourty eight pounds Sterling money and thereupon he brings Suite &ca. And hereinto Court brings the Letters of Administration which Testifie &ca DMacbride pr Quer Plds Jno Doe & Rd Roe And now at this Court to wit the 17th day of Novembr.
