     336                                      November Court 1719
   Robert Cuningham | This being an action of Trespass on the
                at | Case Commenced by the Plt against the Sd Deft
   Charles Stewart — | wherein the Sherf of Kent County to whom the

writ in the Same accon was directed makes
   return to the Court here on the Third tuesday in Novembr. to wit the 17th day
   of the Same month Anno Domi 1719 Endorst Cepi Corpus pr Simon Wilmer Sherf.
     Whereupon at the prayer of the Plt by David Macbride his attry the
   Said Deft is adjudged to give Special Bayle to the afd Accõn and that
   the afd Sherf keep the afd Deft in Safe Custody untill he Shall give Special
   Bayle as afd Thereupon Edward Holyday of Said County Planter present
   here in Court undertakes for the Said Charles Stewart that in case the
   Said Robert Cuningham Shall recover Judgment in the Plea afd agst.
   the Said Charles Stewart or that he the Said Charles Stewart Shall
   be therein Convict that then he the Said Charles Stewart Shall pay the
   Condemnation of the Court thereupon or render his body to the Custody
   of the Sherf of Said County in Satisfaciõn af thereof or that he the Said
   Edward Holyday will do it for him
    and The afd Plt by his attry afd put in a decln in the Said Accõn
   which folls vizt. Kent County in Maryland Ss Charles Stewart of Kent
   County Carpenter was attached to answer unto Robert Cuningham
   of a plea of Trespass on the Case and whereupon the afd Plt by
   David Macbride his attry Complains that whereas the afd Deft the
   twenty nineth day of Aprill in the Year of our Lord Christ one Thousand
   Seven hundred and Nineteen at St. Pauls Parish in Kent County —
   within the Jurisdiciõn of this Court was Indebted^unto the afd Plt in the Sume
   of five hundred and Six pounds of Merchantable Tobacco for diverse
   Goods wares and Merchandizes at the Special Instance and request of
   the afd Deft and to the proper use Benefitt and behoofe of the afd
   Deft before that time Sold and delivered and So thereof being Indebted
   the afd Deft In Consideration thereof upon himselfe assumed and to
   the Same Plt then and there faithfully Promised that he the Said –
   Deft the afd Sume of five hundred and Six pounds of Merchantable
   Tobacco to the Same Plt when thereunto afterwards he Should be
   required would well and truly pay and Content Nevertheless the afd
   Deft his promise and assumption afd in form afd made in no wise
   minding or regarding but plotting and fraudulently Intending the Said
   Plt in this behalfe Craftily and Subtilly to defraud and deceive the
   afd Sume of five hundred^and Sixpounds of Merchantable Tobacco or any
   part thereof to the Same Plt he hath not paid nor in any wise made
   Content for the Same Altho’ to do the Same ye afd Deft afterwards vizt. the
