Novembr Court 1719 335 from him he unjustly detains &ca. And Whereupon the afd Richard by David Macbride his attry Saith that whereas the afd Deft the Nineteenth day of August in the Year of our Lord Christ one Thousand Seven hundred & tenn at St. Pauls Parish in Kent County and within the Jurisdiciõn of this Court by his Certain Bill obligatory which he the Said Deft Sealed with his Seale and as his deed delivered hereinto Court brought whose date is the Same day and Year abovementioned bound himselfe his heirs Executors and Administrators to pay the afd Renatus Smith his heirs Executors Administrators or assignes the afd Full Soum of a Lufun houndred pound of good Sound CLean toBaCo in Caske of the afd Value of Eleven pound Sterlg money in Some Convenient place in Kent County when thereunto afterwards he Should be required Nevertheless the afd Deft the afd full Sume of Eleven hundred pounds of good Sound Clean Tobacco and Cask of the afd value of eleven pounds Sterling money to the afd Renatus Smith in his life time nor to the afd Pltf Since the death of the afd Renatus altho’ often required he hath not rendered nor paid but that to the afd Pltf to render or pay hitherto hath denyed and Still doth deny and unjustly detains to the damage of the Said Plt Twenty^twopoudsn Sterlg money & thereupon he brings Sute &ca. And hereinto brings the Letters of Administration which Testifie &ca —— Jno Doe DMacbride pr Querr Plegs. & Rd Roe and now at this Court to wit the 19th day of November Anno Domi 1719 The afd Deft here present in Court in his proper person comes and Defends the force and injury when &ca. And Says that he Cannot gainsay the Plt his accõn afd So as afd against him brought nor can he Say but that the Said Plt ought to recover his debt as – afd and Cost of Suite agst him which the Said Plt does not gainsay Therefore it is Considered by the Justices here to wit the 19th day of November Anno Domi 1719 afd That the Said Richard Cole administrator as afd Recover against the Said John Wilson as well the Sume of Eleven hundred pounds of Tobacco Debt afd in forme afd Confessed as also the Sume of two hundred Sixty five pounds – of Tobacco by the Court here adjudged to him for his Costs and Charges by him about his Suite in this behalfe laid out and expended and the Said Deft in mercy &ca. and The afd Plt by his attry afd Acknowledges to have Received from the afd Deft the Sume of Six hundred Ninety Three pounds of Tobacco in Part of the Debt in the Judgment afd And that the Said Sume be allowed to the Said Deft in part of the Judgment as afd Jams Smith Clk |
