March Court 1717 33 requested hath not delivered but the Mare & Colt afd that is to Say ye Twenty third [day] of March afd in ye Year afd at the Parish in ye County and Jurisdiciõn afd the Said Jo[hn] to his proper use and profitt Converted and disposed to the Damage of ye Said Timo[thy] Eighteen pounds Sterling money and thereupon he brings Sute &ca Jno Doe TBowne pr Querr plds &ca & Richd Roe And the Said Deft by John Johnson his attry appeared to the above Accõn and prayd liberty thereof to imparle thereto and to answer at Next Court~ which was granted the Same day was given the Plt~. also . Att which Said next Court vizt. the Domini One Thousand Seven hundred and Seventeen The Said cause Standing for tryall came the afd Plt by his afd attry and the Said Deft by his Said Attry who pleads as folls vizt. And the afd Deft by John Johnson his attry comes & defends the force & Injury when &ca. and Saith that he is not guilty of the premises As the Said Plt. hath in his Decln above imposed upon him and of this he puts himselfe on the Country Johnson pr Def~. And the Plt. in like manner TBowne pr qr Thereupon Command was given to the Sherf of Kent County that he immedi: :ately cause to come here Twelve &ca. To Recognize &ca By whome &ca. Who neither &ca Because as well &ca. And the Sherf comes and Saith that he hath ready twelve as Commanded who being called came vizt. William Graves Robert Parks George Reed John Walls John Clarke Nathl Pearce Hance Hanson John Cleaver Joseph Eviritt George Wetherly Edward Cosens William Debruler which Jury being duely elected tryd & Sworn and having heard the Pleadings Evidences and allegations on both Sides do withdraw from the barr and after some time do againe return to the barr and being called over as also the Plt and Deft who do all appear And the Jury being asked whether they are agreed on A ver :dict or not do Say they are and being demanded whether they find for the Plt or Deft~ And whether they find the Deft guilty or not guilty of the Trover do Say they find for the Deft~ Guilty of the Trover & Convertion in manner & form As above declared against him And find Damages Three pounds Currant money with. Cost of Sute And by William Graves there foreman all So Say And the afd plt by his attry afd prays Judgment on the verdict of the Jurors afd = Therefore it is Considered by the Court here vizt. the Same day last mentioned that the afd Plt~. Timothy Hurly Recover against the Said Deft John Buly as well the afd Sume of Three pounds Currant Money Damages by the Jury afd assessed as also the Sume of One Thousand five hundred Twenty five pounds of Tobacco Cost by the afd Plt about his Sute in this behalfe expended and by the Court here of his assent adjudged and the Said Deft in mercy &ca.
