    32                                          March Court 1717
   it is Stated and that he hath not received any part or parcell thereof more than he
   hath there given Credit for

   And the afd Plt by his afd attry prayd that the Sd Deft to his Decln afd may
   Answer . After which the Said Cause was Continued untill the then next
   Court in Course
      Att which Said next Court vizt. the Nineteenth day of November Anno
   Domini One Thousand Seven hundred & Seventeen the Same cause was
   Continued untill the then next Court in Course
        Att which Said next Court vizt. this Twenty first day of March Anno
   Domini One Thousand Seven hundred and Seventeen the Said Accon Standing
   for tryal Came the afd Plt. by his attry afd And no plea being put in by ye
   Said Deft to the Said Accõn This Court gives rule to the Deft to put in a plea
   [to] the afd Accõn in four hours otherwise Judgment to be rendered for want of
   the Same    After which time being out and no plea being put in by
   which the Said Plt may Still remain undefended=   Therefore it is Consi:
  :dered by the Court here vizt. the Same day last mentioned That the afd Plt
   Silvester Garland do Recover against the Said Deft~ Richard Smithers
   as well the afd Sume of Eight hundred Sixty Six pounds of Tobacco Damages
   as also the Sume of Two hundred Eighty Six pounds of Tobacco Cost by the afd .
   Plt~. about his Sute in this behalfe Expended and by the Court here of his assent
   adjudged And that he be taken into Custody

   John Buly —— | Trespass upon ye Case   And Whereupon the afd

Timothy by Thomas Bowne his attry. Complains for
   that Whereas the afd Timothy the tenth day of July in ye Year of our Lord Christ~.
   Seventeen hundred and fifteen at St Pauls Parish in Kent County afd within
   the Jurisdiciõn of this Court was possessed of a Certain Bay Mare of ye price of eight
   pounds Sterling money and one Stone Colt Color Bay of ye price of four pounds
   Sterling money as ye proper Mare and Cost of him the Said Timothy and So being
   thereof possessed the Said Mare & Colt out of his hands and Possession Casually
   lost which Said Mare & Colt afterwards vizt. the Eleaventh day of July in the
   year afd at the parish afd in the County & Jurisdiciõn afd to the hands and
   possession of the afd John by finding came Notwithstanding the Said John
   knowing ye Mare & Colt afd to be the proper Mare & Colt of the Said Timothy .
   and to the Said Timothy of right to belong and appertain Craftilly & fraudulently
   intending the Said Timothy in that behalfe to deceive and defraud the Said
   Mare and Colt to ye Sd Timothy altho? the Twenty third day of March in the Year afd
   and often after at the Parish afd in the County and Jurisdiciõn afd was thereunto
