August Court 1719 323 assembly by Prorogation held at the City of Annapolis in Annarundell County afd the Seventeenth day of July Seventeen hundred and Sixteen Entitulled an Act for Transferring the payment of all Such fines and forfeitures as Shall hereafter arise or happen upon the breach of any the penal Laws of this Province to the Right Honrble the Lord Proprietary that now is among other things therein Contained It’s Enacted by his Lord Ship the Lord Proprietary by and with the advice and Consent of his LordShips Governour and the upper and lower houses of Assembly and by the Authority of the Same that whereby any of the Laws of this Province any fines penalties or forfei: :tures are made payable to or recoverable by the Kings Majesty or in his name to any the uses in the Said Laws Exprest all Such fines forfeitures or penaltys Shod thence forward be payable to the Right Honrble The Lord Proprietary of this Province his heirs and Successors and be Recoverable by him or them or in his or their name to the Same uses as by those Laws are Exprest any Law Statute or Custome to the Contrary Notwithstanding Action hath Accrewed to the Said Laughlin Master and owner of the Said Edward Spargoe who as well for the Said Lord Proprietary as himselfe prosecuteth to require and have of the afd Christopher the afd two Thousand pounds of Tobacco of the value of twenty pounds Sterlg as afd Nevertheless the Said Christopher tho’ often required the afd two thousand pounds of Tobacco or any part thereof to the Said Lord Proprietary and to the Said Laughlin or unto either of them hath not yet rendered but the Same to him the Said Lord Proprietary and to the Said Laughlin who as well for his himselfe prosecuteth as afd yet to render hath altogether refused and Still doth refuse whereupon the Said Laughlin who as well &ca. Saith that he is the worse and hath Damage to the value of two thousand pounds of Tobacco of the value afd and thereupon as wel for the Said Lord Proprietary as himselfe the Said Laughlin brings this Suite &ca. M Howard Attry Plegs de pros Jno& Doe Rd Roe and the Said Christopher Bateman by Thomas Bowne and John Johnson his attrys comes and defends the force and Injury when &ca. And prays leave to imparle hereunto untill next Court And he hath it and the Same day is given to the plts also Att which Said next Court to witt the Eighteenth day of November Anno Domi 1718 comes againe as well the Sd Plts by their attry Deft by his Said Attrys afd And the Same Action is Continued untill the next Court Att which Said next Court to wit the Seventeenth day of March Anno Domi 1719 comes againe as well the Said Plts by their attry afd as the Said Deft by his Said Attrys afd And the Same Action is Continued untill the next Court Att which Said next Court to wit the Sixteenth day of June Anno Domi 1719 comes againe as well the Said Plts. by their attry afd as the Said Deft by his Said Attrys afd And the Same Action is Continued untill the next Court Att |
