322 August Court 1719 of a plea that he render unto the Said Lord Proprietary and the Said Laughlin Flinn two Thousand pounds of Tobacco of the value of twenty pounds Sterling which from the Said Lord Proprietary and the Said Laughlin he Injustly detaineth &ca. And whereupon the Said Laughlin who as well for the Said Propry as for himself prosecuteth in this Behalfe by M: Howard his attry Saith that Whereas by an Act of Assembly of this Province made at a Sessions of Assembly begun and held at the City of Annapolis in Annarundel County the twenty Sixth day of April in the first Year of the Reigne of our Sovereigne Lord the King that now is and in the Year of our Lord God one thousand Seven hundred and fifteen and there Continued till the third day of June in the Year afd Entitulled an Act relateing to Servants and Slaves by the Said Lord the Kings Most Excellent Majesty by and with the advice and Consent of his Majesties Governour Council and the then Assembly of this Province and the Authority of the Same whatsoever Should trade barter Comerce or any ways deale with any Servant whether hired or Indented or a Slave belonging or appertaining to any Inhabitant within this Province without leave or licence first had and obtained from Such Servants Master Mistris Dame or oerseer for his So doing under the penalty of two Thousand pounds of Tobacco the one half to the Master Mistris or true owner of Such goods So purloined bartered or Conveyed away when proved by Sufficient witness or Confession of the party to be recovered in any Court of Record In this Province by Action of Debt Bill plaint or Information wherein no Elsoyn protection or wager of Law to be allowed Nevertheless the Said Christopher Bateman noways regarding the Said Act of assembly nor dreading the penalty thereof on the twenty nineth day of July and twenty Eighth day of June in the Year of our Lord God one Thousand Seven hundred and Eighteen at Saint Pauls Parish in the County afd within the Jurisdicion of this Court did trade barter and Deale with a Certain Indented Servant called Edward Spargoes being the proper Servant of the Said Laughlin Flinn without haveing first obtained leave or Lycence of the Said Laughlin for one Jugg of Madera Wine Containing about two Gallons of wine two bottles of the like wine and two botles of Rum all of the value of twenty Shillings Currant money of Maryland against the forme of the Said Act of Assembly by which and by vertue of one other Act of Assembly made at a Sessions of the Same Assembly |
