304 August Court 1719 him the Sume of thirteen hundred pounds of Tobacco of the value of Thirteen pounds Sterling money which he unjustly detains &ca. And whereupon the afd Plt by — Thomas Bowne his attry Saith that whereas the afd Deft the fifth day of February in the year of our Lord Christ One Thousand Seven hundred and Seven: :teen at St. Pauls Parish in Kent County within the Jurisdiciõn of this Court by his certain Bill obligatory which he the Said Deft Sealed with his Seale and his deed delivered hereinto Court brought the date whereof is the Same day and Year afd Bound himself his heires Exrs. & Admrs. in the afd Sume of thirteen hundred pounds of Tobacco of the afd value of Thirteen pounds Sterlg money for the true payment of the full and Just Quantity of Six hundred fifty pounds of good Sound Merchantable Tobacco Clear of all — manner of trash & ground leaves in Casque to Containe the Same Convenient in the afd County to the Said Plt his Exrs. Admrs. or assignes in and upon the tenth day of October next ensuing the date of the Said Bill without fraud or further delay And the afd Plt in deed Saith that the afd Deft hath not paid to the afd Plt the afd Sume of Six hundred & fifty pounds – of Tobacco in or upon the afd tenth day of October which to him the Said Plt at or upon the afd day he the Said Deft ought to have paid according to the forme and effect of the Said Bill by which accõn hath accrued to the Said Plt to Exact & have of the Said Deft the afd Sume of Thirteen hundred pounds of Tobacco Yett the afd Deft altho’ often required the afd Sume of Thirteen hundred pounds of Tobacco to the Said Plt hath not paid but that to him to render or pay hitherto hath denyed and Still doth denie & unjustly detain to the damage of him the Said Plt twenty Six pounds Sterling money and thereupon he brings Suite &ca TBowne pr Querr plds Jno Doe Rd Roe And now at this Court to wit this 19th day of August Anno Domi 1719 here present the afd Deft in his proper person comes & defends the force and injury when &ca. And Says that he cannot gainsay the Plt his Accõn afd So as afd against him brought nor can he Say but that the Said Plt ought to recover his debt by Occation of the premises afd to the Sume of Thirteen hundred pounds of Tobo and Costs of Sute against him which the Said Plt does not gainsay Therefore it is Considered by the Justices here the 19th day of August Anno Domi 1719 afd That the Said Philip Kennard recover against the Said Mathew Beck as — well the Sume of thirteen hundred pounds of Tobacco his debt afd in forme afd Confessed as also the Sume of two hundred forty Seven pounds of Tobacco by the Court here adjudged him for his Costs and Charges |
