    302                                       August Court 1719
   comes the afd Deft in his proper person and defends the force and injury when
   &ca. And Says he cannot gainsay the Plt in his Accõn afd So as afd against him
   brought nor can Say but that the Said Plt ought to Recover his debt by Occation
   of the premises afd to the Sume of two Thousand three hundred pounds of Tobacco
   and Cost of Suite against him which the Said Plt does not gainsay Therefore it is
   Considered by the Justices here the 19th day of August Anno Domi 1718 afd That the Said
   Philip Kennard Recover against the Said John Twigg as well the Sume of Two
   Thousand Three hundred pounds of Tobacco his debt afd in forme afd Confessed
   as also the Sume of Two hundred forty nine pounds of Tobacco by the Court here
   adjudged to him for his Costs and Charges by him about his Suite in this behalf laid
   out and expended and the Deft in mercy &ca.

   to the Court here on the Third tuesday in August to wit the 18th day of the Same —
   month Anno Domi 1719 being the day of return of Said writ Endorsed Cepi Corpus

   Kent County |       Robert Brown of Kent County Planter alis Dicts Robert
   Maryland | Ss   Brown of Kent County in ye Province of Maryland Planter
   ————— |       was Summoned to Answer unto Phillip Kennard Merchant
   of a plea that he render him the full & Just Quantity of Six hundred and five
   pounds of good Sound Merchantable Tobacco well Conditind Clear of all Manner of
   trash & ground Leaves in Casque to Containe the Same of the Value of Six —
   pounds Sterling money which he unjustly detains &ca
           And Whereupon the afd Plt by Thomas Bowne his attry Saith
   that Whereas the afd Deft the thirteenth day of July in the Year of our Lord Christ
   one Thousand Seven hundred and Seventeen at St. Pauls Parish in Kent County
   within the Jurisdiciõn of this Court By his Certain bill obligatory which he the
   Said Deft Sealed with his Seale and as his deed delivered hereinto Court brought
   the date whereof is the Same day & year afd bound himself to pay unto the afd
   Plt the afd full and just Quantity of Six hundred and five pounds of good Sound —
   Merchantable Tobacco well Conditind Clear of all manner of trash & ground Leaves
   in Casque to Containe the Same of the afd value of Six pounds Sterlg money on
   the then dwelling plantation of the afd Deft in the afd County on demand —
   after the tenth day of October next Ensuing the date of the Said Bill Yett the
   afd Deft the afd Six hundred and five pounds of Tobacco to the Said Plt hath not
   paid altho? to pay the Same he the Same Deft afterwards and after the
