   and he hath it the Same day is given the Plt also ——

The Plt not being an Inhabitant of this County



James Smith of Said County here present in Court
   undertakes for the Said Plt if he Shall be Cast in the Said Accõn that then the
   Said James Smith will pay ye Sd Deft the Cost in the Same accõn if the Plt pay
   it not himself
      whereupon at the prayer of the Plt by his attry the Deft is adjudged to
   give Special baile to the accõn afd Thereupon Roger Hix and Peter Green
   both of Said County planters present here in Court undertakes and either of them
   undertake joyntly and Severaly for the Said Wm Burrose that in Case the Said —
   Gilbert Higginson Shall recover Judgment in the plea afd against the Said
   Wm Burrose or that he the Said Wm Burrose Shall be therein Convict that
   then he the Said William Burrose Shall pay the Condemnation of the Court there:
   :upon or render his body to the Custody of the Sherf of Said County in Satisfacciõn
   thereof or that the Said Roger Hix and Peter Green or one of them will do it
   for him
     And the Said Wm Burrose by David Macbride his attry comes and defends the
   force and injury when &ca. And prays leave to imparle hereunto untill next
   Court which he hath the Same day is given the Plt. also ——
