   282                                       June Court 1719
   as the Said Deft by his attorney afd And the Jurors of that Jury   being Impan:
   :nelled who being called Likewise came to wit Thomas Christian George Ayers
   Thomas Heborn Nicho Waterman John Ashly John Rollinson Thomas Ricker [?]
   Ebenezr. Blackiston Francis Lewis Nicho Joce Richd Davis Richd West who
   being duely Elected tryd and Sworn to Say the truth in the Premises upon
   their Oath do Say that they find the Deft in no Sort guilty of the premises
   above on him imposed as the Said Thomas Tyer against him hath
   declared: Therefore it is Considered by the Justices here the 19th day of June
   Anno Domi 1719 afd That the Said Thomas Tyer take nothing by his writ
   afd but be in mercy for his false Clamour And that the Sd Thomas Mahone
   go thereof without day And also it is Considered by the Justices here that
   the Said Thomas Mahone Recover against the said Thomas Tyer the
   Sume of fourteen hundred Ninety Eight pounds of Tobacco by the Court
   here adjudged to him for his Costs and Charges by him about his defence
   in this behalf laid out & Expended according to the forme of the Statute &ca.
   Wm Dicas proves he attended this Court as an Evide: for Thomas Mahone at
   the Sute of Thomas Tyer Eleven days . ordered by the Justices here that
   the Sd Thomas Mahone pay unto the Sd Wm Dicas for his attendance as
   afd the Sume of Three hundred & Thirty pounds of Tobacco
   Henry Trulock proves he attended this Court an Evide. for Thomas Mahone at
   the Sute of Thomas Tyer Eleven days. ordered by the Justices here that the Sd Thomas
   Mahone pay unto the Sd Henry Trulock for his attendance as afd the Sume of Three
   Hundred and Thirty pounds of Tobacco                           Jams Smith Clk
     Thomas Cowarding proves he attended this Court an Evide. for Thomas Tyer agst.
   Thomas Mahone Six days ordered by the Court here that the Sd Thomas Tyer pay unto
   the Said Thomas Cowarding for his Attendance afd the Sume of one hundred and
   Eighty pounds of Tobacco
     Peter Cowarding proves he attended this Court an Evide. for Thomas Tyer against Thomas
   Mahone Six days ordered by the Justices here That the Said Thomas Tyer pay unto
   the Said Peter Cowarding for his Attendance afd the Sume of one hundred and Eighty
   pounds of Tobacco
     John Faning proves he attended this Court an Evide. for Thomas Tyer against Thomas Mahone
   Eighty days ordered by the Justices here that the Sd Thomas Tyer pay unto the Said John—
   Faning for his attendance afd the Sume of Two hundred and forty pounds of Tobacco
      William Clarke ( Son of Dennis Clarke late of the Sd County decd )
   Chooses Dr. Richard Simmonds of this County his Guardian the Said
   orphan being Sixteen Years old the fifteenth day of this Instant June
