    266                                   June Court 1719
   Anno Domi 1719 That the Said Gilbert Higginson Recover against the
   Said Henry Channoll as well the Sume of Six hundred fifty and Six pounds
   of Tobacco his Debt afd Confessed as also the Sume of Two hundred ninety
   and [five?] pounds of Tobacco by the Court here adjudged to him for his Costs and
   Charges by him about his Suite in this behalfe laid out and expended and
   the Deft in mercy &ca ——

| This being an accõn of debt for the Sume of 684lb Tobo
   Gilbert Higginson | Commenced by the plt against the Said Deft wherein
                at | there Issued a Copy of the Declaration with the writ
   John Pryer — | in the Said accõn and wherein the Sherf of Said County

to whom the writ in the Same accõn was directed
   makes return thereof to the Court here on the third tuesday in June to wit the 16th day
   of the Same month Anno Dom 1719 being the day of return of Said writ Endorst
   Cepi Corpus Copy Decln Served in time pr the Simon Wilmer Sherf
   Whereupon the afd Plt being not an Inhabitant of this County Edward Mitchell of
   the afd County Gent. undertakes for the afd Plt the payment of all Costs in the afd Accõn
   to the Said Deft if the Plt Shall be Cast in the Same
   Maryland Kent County Ss John Pryer of Kent County Planter alis Dics John Pryer of
   ye County of Kent in ye Province aforesaid Planter was Sum&245ned to answer unto
   Giblert Higginson of great Brittaine Merchant of a plea that he render him the
   Sume of Six hundred Eighty foure pounds of Tobacco of the value of Six pounds
   tenn Shillings Sterling money which from him he unjustly detaines and whereupon
   the afd Plt by Thomas Bowne his attorney Saith that whereas the afd Deft the
   Eighteen day of August in the Year of our Lord Christ one Thousand Seven hundred
   & Seventeen at St Pauls Parish in Kent County within the Jurisdiciõn of this Court
   by his certain writing obligatory which he the Said Deft Sealed with his Seale and
   as his deed delivered hereunto Court brought the date whereof is the Same day and
   year afd granted himself holden and firmly bound unto the afd Plt in the afd Sume
   of Six hundred Eighty four pounds of Tobacco of the afd value of Six pounds tenn
   Shillings Sterling money to be paid to the Said Plt when thereunto required
   Yet the afd Deft altho often required the afd Sume of Six hundred Eighty four
   pounds of Tobacco to the Said Plt hath not paid but that to him to render or pay
   hitherto hath denyed and Still doth deny and unjustly detains to the damage of the
   Said Plt one Thousand two hundred pounds of like Tobacco^&caand thereupon he brings
   Sute &ca.                           TBowne pr Querr Plds &ca. John Doe & Richard Roe
   and now at this Court to wit this 18th day of June Anno Domi 1719 here present the afd
   Deft in his proper person Comes and defends the force and injury when &ca. and Says he
   cannot gainsay the Plt his accõn afd So as afd against him brought nor can he Say but
   that the Said Plt ought to Recover his debt by Occation of the premises afd and Costs of
   Suite against him which the Said Plt does not gainsay Therefore it is Considered by
   the Justices here the 18th day of June Anno Domi 1719 afd That the afd Gilbert
   Higginson Recover against the Said John Pryer as well the Sume of Six hundred
