   262                                  June Court 1719
   afd Plt. Convenient in the Said County at or upon the tenth day of March
   next Ensuing the date of the Said Bill and the afd Plt. in deed Saith that
   the afd Deft hath not paid to the afd Plt. the afd Sume of one Thousand
   and ninety three pounds of Tobacco at or upon the afd tenth day of March
   which to him at or upon the Same day he ought to have done according to
   the forme and Effect of the Same Bill by which Action hath accrewed to
   the afd Plt to Exact and have of the afd Deft the afd Sume of two Thousand
   one hundred and Eighty Six pounds of Tobacco Yet the afd Deft altho’
   often required the afd Sume of two Thousand one hundred and Eighty Six
   pounds of Tobacco to the Said Plt hath not paid but that to him to
   Render or pay hath altogether denied and Still doth deny and unjustly
   detaine to the damage of the afd Plt forty Three pounds Sterlg money
   and thereupon he brings Sute &ca.

   Whereupon at the prayer of the Plt by his attry ye Deft is adjudged
   to give Special baile in ye Accon afd And that the Sherf of Said County keep ye
   Sd Deftody in Custody untill he Shall give Special bail as afd
   And the afd Deft: in his proper person comes and defends the force and injury
   when &ca. and Says that he cannot gainsay the Plt his accõn afd So as afd agst.
   him brought nor can he Say but that the Said Plt ought to Recover his
   debt afd and Costs of Suite against him which the Said Plt does not gainsay
   Therefore it is Considered by the Justices here the 18th day of June Anno
   Domi 1719 that the Said Gilbert Falconar Recover against the Said George
   Gleaves Junr. as well the Sume of Two Thousand one hundred and Eighty
   Six pounds of Tobacco his debt afd in forme afd Confessed as also the Same
   to him for his Costs and Charges by him about his Suite in this behalfe laid
   out and expended And the Deft in mercy &ca.
     Thereupon James Rae of Said County Innholder present in Court under:
  :takes for the afd George Gleaves Junr the payment of the Condemnation in
   the Judgment afd or that the Said George Gleaves Junr. his body to the
   Custody of the Sherf of Said County In Satisfacion thereof Shall render or
   that the Said James Rae will do it for him

   According to ye return of Sd Attachmt. on which Michl. Hackett in whose hands ye
   Same Attachment was laid by Michl David Macbride his attry comes and defends
