   hundred pounds of good Sound Merchantable Tobacco with Casque to Contain the Same
   of the afd value of twelve pounds Sterling money to be paid to the Said John when
   thereunto required Nevertheless the afd Owen altho often required the afd full
   and Just Sume of twelve hundred pounds of good Sound Merchantable Tobacco wth.
   Casque to Containe the Same of the afd value of twelve pounds Sterlg money to
   the afd John hath not rendered but [thereto?] to him to render or pay hitherto [hath?]
   gainsayed and Still doth gainsay whereupon he Sayth that he is the worse
   and hath damage to the value of twenty four pounds Sterling money and –
hereupon he brings Sute &ca. And bringeth hereinto Court the writing obli:
   :gotory afd which Testefyeth the debt afd in forme afd whose date is the
   Same day and year above mentioned &ca.
                                                                     DMacbride pr qr. Plds Jno Doe & Rd Roe
   Whereupon at the prayr. of the Plt by his Attry afd the Deft is —
   adjudged to give Special baile to the Accõn afd Thereupon Colo Nathaniel
   Hynson of Said County present here in Court undertakes for the Said Owen
   Mecarthy that in case the said John Cooper Shall recover Judgment in
   the plea afd against the Said Owen Mecarthy or that he the aid Owen
   Mecarthy Shall be therein Convict that then he the Said Owen Mecarthy
   Shall pay the Condemnation of the Court thereupon or render his body to
   the Custody of the Sherf of Said County in Satisfaction thereof or that he
   the Said Nathaniel Hynson will do it for him
        and the afd Deft in his proper person Defends the force and in:
  :jury when &ca. And Says that he Cannot gainsay the Plt. his accon afd So
   as afd agst. him brought nor can he Say but that the Said Plt ought to
   Recover his Debt by Occation of the premises afd and Costs of Sute agst
   him which the Said Plt does not gainsay Therefore it is Considered
   by the Justices here the 18th day of June Anno Domi 1719 afd that –
   the Said John Cooper Recover against the Said Owen Mecarthy as well
   the Sume of Twelve hundred pounds of Tobacco his debt afd in forme afd
   Confessed as also the Sume of Thre hundred twenty nine pounds of Tobo.
   by the Court here adjudged to him for his Costs and Charges by him abt.
   his Sute in this behalfe laid out and Expended and the Deft in mercy
   &ca. But that Execution thereof Cease untill the tenth day of
   November next to which the Plt Consents
