March Court 1718 243 vizt. the thirtieth day of Aprill in the Year afd at the Parish in the County & Jurisdiciõn afd thereunto required hath not delivered but the Said Deft the Gelding afd afterwards vizt. the afd thirtieth day of Aprill in the year afd at the Parish afd in the County & Jurisdiciõn afd to his own proper use and pro: :fit disposed and Converted whereupon the Said Plt Saith he is damnified and hath damage the value of thirty pounds Sterling money and thereupon he brings Sute &ca. TBowne pr Quer plds Jno Doe & Richd Roe . and the afd William Woodland by Michael Howard his attorney cometh and defendeth the force and injury when &ca. And Saith that he is in no Sort Guilty of the premises above on him Imposed as the Said Edwd Hall against him hath Declared and of this he puts himselfe upon the Country &ca. M:Howard pr Deft And the Plt in like manner TBowne pr Querr Thereupon Command was given to the Sherf of Kent County that he cause to come here twelve &ca. To Recognize &ca. Because as well &ca who neither &ca. And the Sherf of Said County comes and makes return that he hath ready twelve &ca as by his precept it was Commanded who being called came vizt. Abraham Redgrave Thomas Medford Thomas Gideons Thomas Cowarden John Underhill William Debruler William Crow Thomas Winn William Duas John Huff Zachariah Mackdaniel George Hastins which Jury being duely Elected tryd and Sworn and having heard the pleading Evidences and allegations on both Sides do withdraw and after Some time do againe return to the barr and being called over as also the Plt and Deft who do appear and the Jury being asked whether they are agreed whether they find for the Plt or Deft do Say they find for the Plt and that the Deft is quilty of the premises as above on him Imposed as the afd Edward Hall hath against him declared and assess damages the Sume of five pounds five Shillings Sterling money with Cost of Sute and by Abraham Redgrave there foreman all So Say the Deft by his afd Attry moves in Stay of Judgment of the verdict of the Jurors afd which is granted And to file reason in twenty four ours otherwise Judgment to be rendered for want of the Same After which time no reasons being put Therefore it is Considered by the Court here vizt. this twentieth day of March Annoq Domini one Thousand Seven hundred and Eighteen That the afd Plt Edward Hall Recover against the Said Deft William Woodland as well the afd Sume of ffive pounds five Shillings Sterling money Damages as also the Sume |
