the Said James Harris who as well prosecuteth for his Said Lord Ship as himselfe the afd two Thousand pounds of Tobacco or afd James Harris (who as well for his Said Lord Ship as himselfe prosecutes as afd) hath above against her declared & of this She puts herself upon the Country &ca M: Howard pr Deft and the Plts. in like manner TBowne pr Plts Thereupon Command was given to the Sherf of Kent County that he cause to come here twelve &ca To Recognize &ca. who neither &ca Because as well &ca And the Sherf returnd that he had ready twelve &ca as by his precept it was Commdd who being called likewise came vizt. John Hall John Turner John Walls William Earley George Read Joseph Hull Samuel Clarke James Stapley Arthur Foreman John True Fredrick Hanson Zachariah Macdaniel which Jury being duely Elected tryd & Sworn and having heard the Pleadings Evidences and allegations on both Sides do with draw and after Some time do againe return to ye barr and being called over as also the Plts and Deft: who do all appear And the Jury being demanded whether they are agreed on a verdict or not do Say they are agreed on a verdict and being asked whether they find for the Said Lord propry and the Said James Harris who prosecuteth for His Said Lord Ship as for himselfe wee the afd Jury Say that we find for the Said Deft Sarah Jewers and wee the Said Jury Say on our Oaths that the afd Sarah Jewers doth not owe James Harris who as well prosecuteth for his Said Lord Ship as himselfe the afd Sume of two Thousand pounds of Tobacco or any part thereof in form as ye afd James Harris who as well for his Said Lord Ship as himselfe prosecuteth as afd hath above against her the Said Sarah Jewers declared and by John Hall there foreman all So Say on which vizt. the Twenty first day of November Annoq Domini one Thousand Seven hundred and Eigh: teen came the afd Deft by her afd attry and prayd Judgment on the verdict of the Jurors afd And the afd Plts by their afd attry moves in Stay of Judgment of the afd verdict which days with the Clarke of this Court after the Court adjourns otherwise Judgment to be render’d for want of the Same within the time afd . Reasons was fild And now at this Court viz this twentieth day of March Annoq Domini One Thousand Seven hundred and Eighteen came the afd Plts by their attry afd And the afd Deft by her afd Attry And the afd - Plts by their attry and the reasons as folls vizt. And the afd James Harris who prosecuteth as well for his Lord Ship as himselfe Says that the Declaration & the Issue on which the Said verdict is founded is not Sufficient to Support and . |
