March Court 1718 219 Answer unto James Harris late Sheriff of Kent County afd a plea of Trespass of the Case hereof he was Not to fail and that he have then and there the Said writ &ca. Att which Said next Court vizt. the Seventeenth day of March the Same year last mentioned the day of return of Said writ Came Simon Wilmer Gent. high Sherf of Said County and made return thereof in these words thereon endorsed as folls vizt. Cepi Corpus pr Simon Wilmer Sherf and a Declaration being filed when Said writ Issued forth and a Copy there: :of Served therewith according to Act of Assembly in Such cases made was as folls vizt. Kent County Ss John Jones of Kent County planter Stands attached to Answer unto James Harris late Sherf of Kent County afd of a plea of Trespass of~ the Case And Whereupon the afd Plt by Thomas Bowne his attry Complain[:] :eth that Whereas the afd Deft the third day of January in the year of our Lord Christ one Thousand Seven hundred and Eleven at S.t Pauls Parish in Kent County within the Jurisdiciõn of this Court was Indebted unto the afd Plt in the Sume of one — hundred and Seventy four pounds of Merchantable Tobacco for two Leveys of two taxables then and there due from the Said Deft to the Said Plt the Same Plt then and there being Sherrif of Kent County afd and So thereof being Indebted to the afd Deft in Consideration thereof afterwards vizt. the afd third day of~ January in the Year afd at the Parish County and Jurisdiciõn afd upon him: :selfe assumed and to the Said Plt then and there last mentioned faithfully promised that he the Said Deft the afd Sume of one hundred and Seventy four pounds of Merchantable Tobacco unto the Said Plt when thereunto — required would well and truely pay and Content and that whereas also the afd Deft afterwards vizt. the third day of Janry in the Year of our Lord — Christ one Thousand Seven hundred and Twelve at the Parish County and – Jurisdiciõn afd was Indebted unto the afd Plt in the Sume of Three hundred and twenty four pounds of Merchantable Tobacco for three Leveys of three Taxables then and there last mentioned due from the Said Deft to the afd Plt the Same Plt. then and there last mentioned being Sherf of Kent County afd and So thereof being Indebted the afd Deft. In Consideration thereof afterwards vizt. the third day of Janry in the Year of our Lord Christ one Thousand Seven hundred & twelve at the Parish County & Jurisdiciõn afd upon himself assumed and to the Said Plt. then and there last mentioned faithfully promised that he the Said Deft the afd Sume of Three hundred and twenty four pounds of— Merchantable Tobacco to the Said Plt. when thereunto required would well and truly pay and Content And that Whereas also the afd Deft after: :wards vizt. the afd third day of January in the Year of our Lord Christ one Thousand Seven hundred and twelve at the parish County and Jurisdiciõn— afd was Indebted unto the afd Plt in the Sume of Sixty pounds of Merchble Tobacco for two Amerciments then and there last mentioned due from the Said Deft to the afd Plt the Same Plt then and there last mentioned being Sherf of Kent County afd and So thereof being Indebted the afd Deft In Consi: deration thereof afterwards vizt. the afd third day of January in the— year of our Lord Christ one Thousand Seven hundred and twelve at the parish County and Jurisdiciõn afd upon himselfe assumed and to the Said – Plt |
