March Court 1718 213 of Langfords bay Upper hundred Yeoman the first day of March in the Year of our Lord one Thousand Seven hundred & Seventeen at the Parish of S.t Pauls in the County afd & within the Jurisdiciõn of this Court the fear of God before his Eyes not having but by the Instigation of the Devill did commit fornication with a certain Elizabeth Lock to the high displeasure of Almighty God to the evill & pernitious example of others & against the peace of our Said Lord proprietarie his Rule & dignity & against the form of an Act of Assembly of this Province now in force in Such Cases made & provided Johnson pr Dnõn propr. Evide. Eliz.a Lock Under the preceeding bill was as folls vizt. true bill Charles Ringgold foreman And the afd James at this Court vizt. the Seventeenth day of March Annoque Domini one Thousand Seven hundred and Eighteen in his proper person apprs to the afd Indictment And the same being read to him as afd pleads not guilty & for tryal puts himselfe on God & the Country James Dill in prop.r prson And he Who prosecutes for the Lord prop.r in like manner Johnson Thereupon Command was given to the Sherf of Kent County that he cause to come here twelve &ca. because as well &ca. to Recognize &ca. who neither &ca. And the Sherf of Said County comes and makes return that he hath here ready twelve as by his precept it is Commanded who being called came vizt. Abraham Redgrave Thomas Medford Thomas Gideon Thomas Cowarden John Underhill William Debruler William Crow Thomas Winn William Dicas John Huff Zactree Mackdaniel Thomas Piner who being duely Acted tryd & Sworn and having heard the Pleadings Evidences and allegations on both Sides Thomas Bowne one of the attrys of this Court ordered as Council for the afd James Dill and desires that Eliz Lock may not be admited as an Evidce. She being the person that Commited the fornication with the afd James This Court adjudges her to be an Evid.e and is Sworn accordingly to the Jury and the Jury afd do withdraw. and after Some time do againe Return to the barr and being called over (as also the afd James Dill) and being asked if they are agreed on a verdict do Say they are agreed and being asked whether they find the Said James Dill is guilty or not guilty as he Stands Indicted do Say they find the Said James Dill not guilty as he Stands Indicted and by Abraham Redgrave there forema[n] all So Say : Therefore it is Considered by The Court here vizt this Twentieth day of March Anno Domini One Thousand Seven hundred and Eighteen That the afd James Dill as to the afd Indictment go thereof without day and - that he be there from acquitted he paying the Sume of Eight hundred and nineteen pounds of Tobacco Cost accruing on the Premises afd to the officers of this Court ordered by The Court that the afd James Dill give Surety for the fees on the premises afd on which Mr. Gilbert Falconar of this County Comes into Court and Saith that he will pay the fees due on the premises afd ordered by the Court here that The afd James Dill Enter into Recognizance for his appearance to next Court to Answer unto what Shall be objected against^himon Accot. of his mai[n] |
