                                         Errors Excepted pr Phile Hemsley ———
   and the afd Deft appeared in his proper person to the afd Accon
   and rule was given to the Said Deft. to plead to the afd Accõn in
   thirty days after the Court adjourned for want of the Same Judgmt.
   to be rendered and thereupon the Same cause was Continued untill
   then next Court
      Att which Said next Court vizt. this Twenty first day of November
   Annoq Domini One Thousand Seven hundred and Eighteen Came the
   afd Plt. by his afd attry and moved to the Court for Judgment on ye Decln
   afd The afd Deft having fild no plea to the afd Accõn within the—
   time of the afd rule nor hath any been offered Since whereby the—
   Said Plt may Still remain against the Said Defendant without defence
   Therefore it is Considered by the Court here vizt the Same year
   last mentioned That the afd Plt Philemon Hemsley do recover against
   the Said Deft Richard Cole as well the Sume of Eighteen hundred
   and forty five pounds of Tobacco Damages on Account of the Said Deft
   his not performing his promises and assumptions afd as also the —
   Sume of Three hundred ninety Eight pounds of Tobacco Cost by the
   afd Plt. about his Sute in this behalfe expended and by the Court —
   here of his assent adjudged and that the Said Deft be taken in—
