158 November Court 1718 Milk Glasses for the Sume of Eighteen pounds of Merchantable Tobacco and one Jappand box for the Sume of twenty four pounds of Merchantable Tobacco in the whole amounting unto the Sume of Three Thousand Eight hundred and forty two pounds of Merchantable Tobacco then and there upon himselfe assumed and to the Said Plt then and there faithfully — promised that he the Said Deft the afd Sume of Three Thousand Eight hundred and forty two pounds of Merchantable Tobacco unto the Said Plt when thereunto required would well and truly pay and Content And that whereas also the afd Deft afterwards vizt. the afd Twentieth day of Ffebruary in the Year of our Lord Christ one Thousand Seven hundred and Sixteen at St. Pauls Parish in Kent County within the Jurisdiciõn of this Court In Consideration that the afd Plt at the like Special Instance and request of the afd Deft had then and there last mentioned Sold and —— delivered unto the afd Deft and to the proper use and Behoofe of the afd Deft the divers Goods & Merchandizes in an Accot. hereto annexed Sett forth upon himself assumed and to the Said Plt then and there last mentioned faithfully promised that he the Said Deft So much Merchantable Tobacco as the afd last mentioned Goods and Merchandizes Sold and delivered as last Said at the time of the Sale and delivery thereof at reasonable rates and prices were worth and amounted to unto the Said Plt when thereunto required would well and truly pay and Content And the afd Plt indeed Saith that the afd last mentioned Goods and Merchandizes Sold and delivered as last Said at the time of the Sale and delivery thereof at reasonable — rates and prices were worth and amounted unto the Sume of Three— Thousand Eight hundred and forty two pounds of Merchantable Tobacco in manner as in Said Acco.t Sett forth of which the Said Plt then and there last mentioned had notice Nevertheless the afdf Deft his Severall promises and assumptions afd in forme afd made as to the afd Severall Sumes of Tobacco which in the whole amounts unto the Sume of Seven Thousand Six hundred and Eighty four pounds of Tobacco he hath not minded nor in any wise keept but altho’ he the Said Deft hath paid and Satisfied unto the afd Plt one Thousand Nine hundred and ninety Seven pounds of Tobacco of the afd Seven Thousand Six hundred and Eighty four pounds of Tobacco part Yet the afd Deft his promises and assumptions as to the Sume of Ffive Thousand Six hundred and Eighty Seven pounds of Tobacco of the afd Sume of Seven Thousand Six hundred Eighty four pounds of Tobacco residue little regarding but plotting and fraudulently Intending him the Said Plt of the afd Sume of five — Thousand Six hundred & Eighty Seven pounds of Tobacco craftily and Subtilly to deceive and defraud the afd Sume of Ffive Thousand Six— hundred and Eighty Seven pounds of Tobacco to the Said altho’ — afterwards vizt. he the Said Deft the fourth day of November in the Year of our Lord Christ one Thousand Seven hundred and Seventeen and often after at the parish County and Jurisdiciõn afd was thereunto required |
