November Court 1718 18[7] Andrew Ruddle and Joseph Wood good and Lawfull men of my Bailywick and So answers Simon Wilmer Sherf and the afd Deft by John Johnson his attorney comes & prays Judgmt. of the afd writ of Scire facias & Saith that the afd Plt ought not to have be: :cause he Saith that the afd Plt hath not Set forth in his Said writ of Scire facias against any Execution Issued out against the Said John Cockram the original writ or which the Said Judgment was obtained Wherefore he pray[s] Judgment of the afd writ Johnson pr Waterman And the afd cause was Continued untill the then next Court in Course Att which Said next Court vizt the nineteenth day of August the Same year last mentioned the Said cause was Continued untill the then next Court in Course Att which Said next Court vizt This Twenty first day of November the Same Year last mentioned Came the afd Plt by Thomas Bowne his attry and the afd Deft by his afd attry. who withdraws the plea afd And Saith that he hath not been informed by the afd Deft what to plead and that he can say nothing why Judgment Should not be entered agtainst him whereby the afd Plt. may Still remain undefended Therefore it is Consid[:] :ered by the Court here vizt. the Same day last mentioned That the afd Renatus Smith Shall Recover against the afd Nicholas Waterman the afd Sume of five hundred pounds of Tobacco the debt in the Judgment afd rend: :ered as also the Sume of three hundred and fifty two pounds of Tobacco Cost in the afd Judgment mentioned which in the whole amounts to the Sume of Eight hundred fifty two pounds of Tobacco and also the Sume of two hundred and Eighty pounds of Tobacco Cost Expended by the afd Plt about the afd writ of Scire facias And that the Said Plt have thereof Execution against the afd Nicholas Waterman of his Lands and Chattells &ca Jams Smith Clk
Christ one Thousand Seven hundred and Sixteen at St. Pauls Parish in Kent County within the Jurisdiciõn of this Court In Consideration that the afd Plt at the Special Instance and request of the afd Deft had then and there bargained Sold and delivered unto the afd Deft and to the proper use and behoofe of the afd Deft one Servant woman named Mary Swain for the Sume of two Thousand pounds of Merchantable Tobacco and one named Ann Tayler for the Sume of one Thousand Eight hundred pounds of Merchantable Tobacco and two milk |
