186 November Court 1718 and his associates then Justices of the Said Lord the King of the Court and County afd of and upon the plea afd had recovered against the afd John Cockram as well the afd Sume of five hundred pounds of Tobacco debt as also the Sume of Three hundred fifty two pounds of Tobacco Costs which were to the Said Renatus Smith in the Said Court here were adjudged for his damages which he had by occation of detaining of his Debt afd whereof he is Convicted Sustained as by the Record & process thereof in the Same Court of his Said Lord the King before the Said Justices here Likewise residing doth manifestly appear Yet the afd John Cockram his body to the Custody of the Sherf of Said County did not deliver nor to the afd Renatus Smith the debt and Cost afd Satisfied as by the Information of the afd Renatus Smith (wee Receive i:e: the Lord proprietarie Receive and we being willing that those things in the afd Court before the afd Justices Should be rightly Acted wee Command You that by good and Lawfull men of our Bailywick you make known to the afd Nicholas Waterman that he be and appear before the Justices of our next County Court to be held at our Court house in the Town of Chester in Said County on the Third Tuesday in June next to Shew cause if any he have or know to Say wherefore the afd Renatus Smith wherefore the afd five hundred pounds of Tobacco the Debt afd and the Sume of Three hundred fifty Two pounds of Tobo. Damages appeared by him in forme afd Recognized of his Lands and Chattells to be made or the afd John Cockram to render himselfe ought not according to the form of the Recognition appeared if to him it Shall Seem Expedient And have you there the names of those by whom to him you make known and also this writ witness Nathl Hynson Gent. chiefe Justice Justice of our Said Court this 21st day of March in the third year of his Lord Ships Dominion &ca. Anno Domi 1717 TBowne pr Querr Jams Smith Clk Att which Said Court vizt. the Seventeenth day of June Annoq Domini one Thousand Seven hundred and Eighteen the day of return of Said — writ came Simon Wilmer Gent. high Sherf of Said County and made return thereof in these words thereon Endorsed as folls vizt. By vertue of the within writ to me directed I certifie unto the Justices within mentioned that I have made known unto the within named Nicholas Waterman that he be and appear before the Justices within mentioned at the time and place within mentioned to Shew cause if any he have or know to say wherefore the within named Renatus Smith the afd five hundred pounds of Tobacco the debt within mentioned and three hundred and Ffifty pounds of Tobacco Damages appeared by him in forme within mentioned Recognized of his Lands & Chattells to be made or the afd John Cockram to render himselfe ought not according to the forme of the Recognition appeared if to him it Shall Seem Expedient before Andrew |
