November Court 1718 185 Therefore it is Considered by the Court here vizt. the Same day last~ mentioned That the afd Plt Mathias Vanderheyden Shall recover against the Said William Frisby his debt aforesaid being the Sume of four and twenty Thousand two hundred twenty pounds of Tobacco as also the Sume of four hundred pounds of Tobacco Cost by the afd Plt expended of the goods and Chattells which were of the afd Maurice Davis the Intestate at the time of his death and which Shall hereafter come and the afd Wm Frisby in mercy Jams Smith Clk
our Lord King George here that is to Say the fifteenth day of November Annoq Domini one Thousand Seven hundred and fifteen in the Second year of his Said late Majesties King George of Great Brittaine before James Harris Gentleman and his associates then Justices of our Said Lord the King of his Said Court for the Said County of Kent here that is to Say at a Court in the Court house in the Town of Chester in Said County prsent in the Said Court in his proper person assumed upon himselfe - that if it Should happen that a Certain John Cockram of Kent County Planter alis Dics Jno Cockram of Kent County Planter Should be Cast or Judgment against the Said John Cockram Should be given att the Sute of a certain Renatus Smith by ye name of Renatus Smith of Queen Ans County Gent in a plea of Debt of five hundred pounds of good Sound Merchantable leafe Tobacco then in the Said Court before the Said Justices depending Then the afd Nicholas Waterman did undertake for the Said John Cockram the payment of the Debt & Cost if it Should happen that the Said Renatus Smith Should obtain Judgment against the Said John Cockram in the Said Accõn of Debt and the Said John Cockram the Condemnation Should not Satisfie nor himselfe to the Custody of the Sherf of Said County deliver or that the Said Nicholas Waterman the body of the Said John Cockram Should not render &ca. which Certain Sume the afd Nichos. Waterman acknowledged of his Lands and Chattells to be made and to the behoofe & use of the Said Renatus Smith to be Leveyed if it Should happen the Said John Cockram in any the premises to make default and thereof in Lawfull manner to be Convicted as by the Record and process thereof in the Said Court of the Said Lord the King here residing mainifestly appeareth and altho the afd Renatus Smith afterwards vizt. on the Same day last mentioned in the Said County Court before the Said James Harris Gent and |
