    182                                November Court 1718
   by his Certain writing obligatory which ye Said Deft Sealed with his
   Seal and as his deed delivered hereinto Court brought the date whereof is
   the Same day & Year afd Grated himselfe holden & firmly bounden to
   the afd Plt in the afd Sume of Nine hundred pounds of Tobacco qua:
  :lified as afd to be paid to the Said Plt when thereunto required Yet the
   afd Deft altho often required the afd nine hundred pounds of Tobacco
   to the afd Plt hath not rendered but that to render hitherto hath—
   denied and Yet denys to the damage of the Said Plt twelve hundred
   pounds of Tobacco and thereupon he brings Sute &ca                  Jno Doe

   and the afd John Cookson being called came and the afd Plt by his
   afd attry prays that the Said Deft Wm Cookson may give Special bail
   to the afd Accõn which is granted and that he be kept in Safe Custody
   by the Sherf of Said County untill he Shall give Special baile as afd
     After which William Davis of Said County here in Court cometh and —
   acknowledged himselfe Special bail in the afd Accõn and doth undertake
   the payment of the debt afd and Cost thereon accruing if the afd John—
   Cookson Shall be cast in the Same And the Condemnation Shall not
   Satisfie nor himselfe to the Custody of the Sherf of Said County deliver or
   that the afd William Davis the body of the afd John Cookson Shall not
   render &ca.
    and the Said John Cookson in his proper person appeared to the afd
   Accõn and Saith that he cannot gainsay the Accõn afd of him the Said
   Deft nor but that the writing obligatory above mentioned is his Act.
   and deed and that he oweth unto the afd Plt the afd Sume of nine—
   hundred pounds of Tobacco and is willing that Judgment Should be—
   rendered against him and Cost thereon accruing : Therefore it is
   Considered by the Court here vizt this Twenty first day of November
   Anno Domini one Thousand Seven hundred and Eighteen That
   the afd Plt. Samuel Phillips do recover against the Said John Cookson
   as well the afd Sume of Nine hundred pounds of Tobacco Debt as also
   the Sume of Two hundred Seventy Seven pounds of Tobacco Cost by the
   afd Plt. about his Sute in this behalf Expended and by the Court—
   here of his assent adjudged and the Said Deft in mercy &ca
