Cæcil County Tayler Deceased at the time of his death who dyed Intestate as it’s Said als Dics Marris Davis of Cæcill County not administred by Sarah Daviss deceased relict and Administratrix of all and Singular the Goods and Chattells which were of the afosd Maurice Davis if he Should be found in his Bailywick and him Safe keep So that he have his body before his Said Lord Ships Justices of the peace for Said County at a Court to be held for Said County at the Court house in the Town of Chester in Said County to answer unto Mathias Vanderheyden of a plea that he render him the Summe of Ffour and Twenty Thousand two hundred Twenty pounds of good Sound Merchantable Bright - Tobacco and Cask to Contain the Same of the value of Seventy five pounds Sterling money which from him he unjustly detains &ca And that he have then and there the Said writ &ca. Att which Said next Court vizt. the Seventeenth day of June Anno Domini one Thousand Seven hundred and Eighteen the day of return of Said writ came Simon Wilmer Gent. high Sherf of Said County and made return thereof in these words thereon endorsed as folls vizt. Cepi Corpus pr Simon Wilmer and a Declaration being filed when Said writ Issued forth and a copy thereof Served therewith according to Act of Assembly in Such Case made was as folls. vizt. Kent County Ss William Frisby of Kent County Gentleman Administrator of the goods and Chattells which were of Maurice Daviss late of Cæcil County Tayler Deceased at the time of his death who dyed Intestate as it’s Said als Dics Marris Davis of Cæcill County not Administred by Sarah Daviss deceased relict and Adminis: :tratrix of all and Singular the goods and Chattells which were of the afosd. Maurice Davis was Summoned to answer unto Mathias Vanderheyden of a plea that he render him the Summe of four and Twenty Thousand two hundred twenty pounds of good Sound Merchantable Bright Tobacco and Cask to contain the Same of the value of Seventy five pounds Sterling money which from him he unjustly detains &ca. and whereupon the afd Plt by Michael Howard his attry saith that whereas the afd Maurice in his lifetime the Six[th] day of Aprill in the Year of our Lord Christ one Thousand Seven hundred and thirteen at St. Pauls Parish in Kent County within the Jurisdiciõn of this Court by his certain writing obligatory which he the Said Maurice in his lifetime Sealed with his Seale and as his deed delivered hereinto Court brought the date whereof is the Same day and Year afd Granted himselfe holden and firmly bound unto the afd Plt. in the afd Sume of four and Twenty Thousand Two hundred twenty pounds of good Sound Merchantable Bright Tobacco and Cask to contain the Same of the afd value of Seventy five pounds Sterling money to be paid unto the afd Plt when thereunto required Yet the afd Maurice in his lifetime and the afd Sarah in her lifetime after the death of the afd Maurice |
