November Court 1718 181 Deft hath hitherto denied and Still doth deny and unjustly detain to the damage of the Said Plt twelve hundred pounds of Tobacco and thereupon he brings Sute &ca TBowne pr Querr plds Jno Do Rd Roe and the afd Deft in his proper person appeared to the afd Accõn and Saith that he cannot gainsay the accõn afd of him the Said Plt. nor but that he is indebted to the afd Plt the afd Sume of Six hundred pounds of Tobacco and is willing that Judgment Should be entered for the Same and Cost thereon accruing. Therefore it is Considered by the Court here vizt. this Twenty first day of November Annoq Domini one Thousand Seven hundred & Eighteen That. the afd Plt. John March do recover against the Said Deft. James Watson as well the afd Sume of Six hundred pounds of Tobacco Damages as also the Sume of Two hundred forty Three pounds of Tobacco Cost by the afd Plt about his Sute in this behalfe expended and by the Court here of his assent. adjudged and the Said Deft in mercy &ca Jams Smith Clk
if they Should be found in his Bailywick and him Safe keep So that he have his body before his Said Lord Ships Justices of the next Court to be held at our Court house in the Town of Chester in Said County to answer unto Samuell Phillips of a plea that they render unto him the full and Just Summe of Nine hundred pounds of Good Sound Clean Merchantable Leafe Tobacco Clear of all trash and Ground Leaves in Casque to Contain the Same of the value of Nine pounds Sterling money which from him they unjustly detain &ca. And that he have then and there the Said writ &ca Att which Said next Court vizt. the Eighteenth day of November the Same Year last mentioned the day of return of Said writ came Simon Wilmer Gent high Sherf of Said County and made return thereof in these words there: :on endorsed at folls vizt. Non Est Inventus William Cookson Cepi Corpus John Cookson pr Simon Wilmer Sherf. and a Declaration being fild in Said Accon which folls vizt Kent County Ss William Cookson of Kent County Planter and John Cookson of Kent County Planter alis Dics William Cookson & Jon Cookson of Kent County Planters was Summoned to .
