178 November Court 1718 Instance and request of the afd Deft had then and there Sold and delivered to the Said Deft to the proper use and behoofe of the afd Deft a Servant woman in an Accot. hereto annexed Shewn for two Thousand five hundred pounds of Merchantable Tobacco upon himselfe assumed and to the Said Plt. then and there faithfully Promised that the Said Deft the afd Sume of Two Thousand five hundred pounds of Merchantable Tobacco to the Said Plt when thereunto required would well and truly pay & Content And that whereas also the afd Deft afterwards vizt. the afd twenty Seventh day of November in the Year of our Lord Christ one Thousand Seven hundred and Sixteen at the parish County and Jurisdiciõn afd In Consideration . that the afd Plt at the like Special Instance and request of the afd Deft had then and there last Said Sold and delivered to the afd Deft to the . proper use and behoofe of the afd Deft a Servant woman in the afd — Accot. Shewn upon himselfe assumed and to the Said Plt then and — there last Said faithfully promised that he the Said Deft So much— Merchantable Tobacco as the Said Servant woman Sold and delivered as afd at the time of the Sale and delivery thereof at reasonable price were worth unto ye Sd Plt when thereunto required would well and truly pay and Content And the afd Plt. in deed Saith that the afd Servant woman Sold and delivered as afd at the time of the Sale & delivery thereof at a - Reasonable price was worth the Sume of two Thousand Ffive hundred pounds of Merchantable Tobacco of which the Said Deft then and there last mentioned had Notice and that whereas also the afd Deft afterwards vizt. the Ffirst day of December in the Year of our Lord Christ one Thousand Seven hundred & Sixteen at St. Pauls Parish in Kent County afd within the Jurisdiciõn of this Court In Consideration that the afd Plt. at the like Special Instance & request of the afd Deft had then and there last mentioned Sold and delivered to the afd Deft to the proper use and behoofe of the afd Deft divers goods and Merchandizes for the Sume of Ffive hundred and Eighteen pounds of— Merchantable Tobacco as in Account hereunto Annexed Set forth upon— himselfe assumed and to the Said Plt then and there last Said faithfully — Promised that he the Said Deft the afd Sume of five hundred & Eighteen pounds of Merchantable Tobacco to the Said Plt when thereunto required would well and - truly pay and Content And that Whereas also the afd Deft afterwards vizt the afd first day of December in the Year afd at the Parish County ahd Jurisdiciõn afd In Consideration that the afd Plt at the like Special Instance and request of the afd Deft had then and there last Said Sold and delivered to the afd Deft to the proper use and behoofe of [Sd?] Deft divers Goods and Merchandizes as in Accot. hereunto Annexed Set forth upon himselfe assumed and to the Said Plt then and there last mentioned faithfully promised that he the Said Deft So much Merchantable Tobacco as the afd last mentioned Goods and Merchandizes Sold and delivered as afd at the time of ye Sale & delivery thereof at reasonable rates and prices were worth and amounted to unto the Said Plt. when thereunto required would well and truly pay and Content and the afd Plt Indeed Saith that the afd last mentioned goods and Merchandizes Sold and delivered as afd at the time of the Sale and delivery thereof at reasonable rates and prices were worth and amounted to the Sume [of] five hundred and Eighteen pounds of Merchantable Tobo. in manner as in Said Accot.
