    176                                      November Court 1718
   Domini one Thousand Seven hundred and Eighteen The Said Cause was Continued
   untill the then next Court—
   Att which Said next Court vizt. the nineteenth day of August the Same year
   last mentioned the Said Cause was Continued untill the then next Court ——
   Att which Said next Court vizt. the Eighteenth day of November the Same
   Year last mentioned came the afd Plt by Thomas Bowne his attry and
   declare as folls vizt. Kent County Ss John Johnson of Kent County Planter was
   attached to Answer unto Valentine Brown of a plea of Trespass on ye Case
    and whereupon the afd Plt. by Thomas Bowne his attry Complains —
   that whereas the afd Deft the twenty third day of March in the Year of our
   Lord Christ one Thousand Seven hundred and fifteen at St. Pauls Parish in
   Kent County within the Jurisdiciõn of this Court in Consideration that the afd
   Plt at the Special Instance and request of the afd Deft had Sold and delivered
   to the Said Deft to the proper use of the Said Deft divers goods and Merchant:
   :dizes in Account thereunto Annexed Specifically Sett forth upon himselfe
   assumed and to the Said Plt then and there faithfully promised that he—
   the Said Deft so much Merchantable Tobacco as the afd goods and Merchant
  :dizes Sold and delivered as afd were at the time of Sail and delivery —
   thereof at Reasonably rates and prices worth and amounted to unto the
   Said Plt when thereunto required would well and truly pay and —
   Content and the afd Plt Indeed Saith that the afd Goods and Merchandizes
   Sold and delivered as afd at the time of the Sail and and delivery thereof
   at reasonable Rates and prices were worth and amounted to Seven—
   hundred and ninety pounds of Merchantable Tobacco in manner
   as in the Said Acco.t Sett forth of which the afd Deft. had Notice Never:
  :theless the afd Deft his Severall promises and assumptions afd little
   minding but fraudulently Intending the Said Plt. in that behalf to deceive
   and defraud the afd Seven hundred and ninety pounds of Tobacco to the—
   Said Plt altho’ afterwards vizt. at St. Pauls Parish in Kent County the —
   twenty fourth day of March afd in the year afd and often after in the
   year afd in the afd Jurisdiciõn by the afd Plt thereunto required hath not
   paid nor made Content for the Same but that to pay or Content the Said —
   Deft hitherto hath denied and Yet denies to the damage of the Said Plt
   one Thousand pounds of Tobacco afd and thereupon he brings Sute &ca.
