166 November Court 1718 Eleventh day of Mary in the Year of our Lord Christ one Thousand Seven hundred and nine at S.t Pauls Parish in Kent County within the Juris: :diciõn of this Court had Accounted with the afd Edward Chetham in his life time of divers Sumes of money to the Same Edward Chetham in his life time by the afd Edward Warner then and there oweing and — unpaid and upon that Accounting the afd Edward Warner then and there in the life time of the Said Edward Chetham was found in— arrearage towards the Said Edward Chetham in the Sume of two - pounds five Shillings and Six pence Sterling money the afd Edward Warner in Consieration thereof afterwards vizt. the Eleventh day of May in the Year afd at S.t Pauls Parish in Kent County within the Jurisdiciõn of this Court in the life time of the Said Edward Chetham upon himselfe assumed and to the Said Edward Chetham then and there last mentioned faithfully promised that he the Said Edward Warner the afd two pounds five Shillings and Six pence Sterling money to the afd Edward Chetham when thereunto required would well and truly pay and Content Nevertheless the afd Edward Warner his promise and —— assumption afd in form afd made litle minding but fraudulently Intending to deceive and defraud the afd two pounds five Shillings and Six pence Sterling money or any part thereof to the afd Edward Chetham in his life time or after the death of the Sd Edward Chetham to the Said Mary and Henry while the Said Mary was Sole or to the Said James and Mary and Henry or either of them after Espousalls Cele: brated between the Said James and Mary or to the Said James and Mary or either of them after the death of the Said Henry hath not paid or to either or any of them for the Same made Content altho’ that to do — the Said Edward Warner afterwards vizt. the tenth day of January in the Year of our Lord Christ one Thousand Seven hundred and Nine and often after at S.t Pauls Parish in Kent County afd within the Jurisdiciõn of this Court by the afd Edward Chetham in his life time and after the afd Edward Chetham death by the afd Mary and Henry while the Said Mary was Sole and Since the death of the Said Henry and the Espousalls afd by the Said James and Mary the Eighth day of July in the Year of our Lord Christ one Thousand Seven hundred and thirteen at S.t Pauls Parish in Kent County within the Jurisdiciõn of this Court was thereunto required But that to the Said Edward Chetham in his life time or after the death of the Said Edward Chetham to the afd Mary and Henry while She was Sole and after the Espousals afd to the afd James and Mary & Henry or either of them in the life time of the Said Henry and to the Said James and Mary Since the death of the Said Henry hitherto to pay hath denied and to the Said James and Mary to pay Yet doth deny to the damage of them the Said James and Mary four pounds Tenn Shillings Sterling money and in delay of the Execution of the Testament afd and thereupon they bring Sute &ca. and brings here into Court the— Letters Testamentary of the afd Edward Chetham by which it will— appear |
