of Chester in Said County to Answer unto James Heath and Mary his wife late called Mary Chetham Executrix together with a Certain Henry Chetham of the last will and Testament of Edward Chetham late of Queen Anns County deceased which Said Henry Chetham is also Since dead whom the Said Mary Survied of a plea of Trespass upon the Case and that he have then & there the Said writ &ca. Att which Said next Court vizt. the nineteenth day of August the Same Year last mentioned the day of return of Said writ came Simon Wilmer Gent. high Sherf of Said County and made return thereof in these words thereon endorsed as folls vizt. Non Est Inevntus pr Simon Wilmer Sherf Likewise Commanded it ws to the Sherf of Kent County the Twenty Second day of August the Same Year last mentioned That he take Edward Warner^late of Kent County Merchant if he Should be found in his Bailywick and him Safe keep So that he have his body before his Said Lord Ships Justices of the next Court to be held for Said County at the Court house in the Town of Chester in Said County to Answer unto James Heath and Mary his wife late called Mary Chetham Executrix together with a Certain Henry Chetham of the last will and Testament of Edward Chetham late of Queen Anns County deceased which Said Henry Chetham is also Since dead whom the Said Mary Survied of a plea of Trespass upon the Case and that he have then and there the Said writ &ca. Att which Said next Court vizt the Eighteenth day of November the Same year last mentioned the day of return of Said writ came Simon Wilmer Gent high Sherf of Said County and made return thereof in these words thereon Endorsed as folls viz Non Est Inventus pr Simon Wilmer Sherf and a Declaration being fild and a Copy thereof Sent with the last writ to be left with the attry in fact of the afd Edward Warner which folls vizt Kent County Ss Edward Warner late of Kent County Merchant Stands attached to answer unto James Heath and Mary his wife late called Mary Chetham Executrix together with a Certain Henry Chetham of the last will and Testament of Edward Chetham late of Queen Anns County deceased which Said Henry Chetham is also Since dead whom the Said Mary Survied of a plea of Trespass upon the Case . . . And Whereupon the afd James and Mary by Thomas Bowne their attry Complain for that whereas the afd Edward Warner the Eleventh |
