November Court 1718 161 in the year of our Lord one Thousand Seven hundred and Sixteen at the Parish of S.t Pauls in Kent County and within the Jurisdiciõn of this Court in Consideration that the afd Plt had then and there at the Special Instance and request of the afd Deft & for his the Said Defts proper use & behoofe Sold and delivered unto the afd Plt divers goods wares & Merchandizes in an Acco.t hereunto annexed particularly menconed did upon himselfe assume & to the Said Plt then and there faithfully promise that he the Said Deft all Such Sume money as the Said Goods wares and Merchandizes at the time of ye Sale and delivery thereof were Reasonably worth & amounted unto unto the Said - Plt when he Should be thereunto required would well and truly pay and content and the Said Plt in fact Saith that the afd goods wares and Merchandizes at the time of the Sale & delivery thereof were reasonably worth & amounted unto the Sume of Twelve pounds Sixteen Shillings & Six pence Currant money of Maryland of which the Said Deft then and there had notice and whereas the afd Deft the afd third day of November in the Year afd at the Parish County & Jurisdiciõn afd was indebted unto the afd Plt in the Sume of twelve pounds Sixteen Shillings & Six pence like money of Maryland for divers goods wares & Merchandizes in an Accot thereof hereto annexed parti[:] :cularly menconed by him the Said Plt to him the Said Deft at his the Said Defts Special instance & request and for his the Said Defts proper use and behoofe then & there Sold & delivered and being So indebted the afd Deft the Said day & year last menconed at the parish County and Jurisdicicõn afd did upon himself assume and to the Said Plt then and there last Said faith[:] :fully promised that he the Said Deft the Said last mencõned Sum of twelve pounds Sixteen Shillings & Six pence Currant money of Maryland to the Said plt when he Should be thereunto required would well & truly content & pay — Yet Nevertheless the afd Deft his Severall promises and assumptions afd in forme afd made he hath not minded or regarded but altho’ he hath paid & Satisfied unto the Said Plt the Sume of Seven pounds three Shillings and one penny —— half penny part of the Said Sume of twelve pounds Sixteen Shillings & Six pence in the first and Second assumption menconed Yet as to the Sume of five pounds thirteen Shillings and four pence half penny residue of the Said Sum of twelve pounds Sixteen Shillings & Six pence litle minding or regarding but plotting & fraudulently intending him the Said Plt in this behalf craftily and Subtilly to deceive & defraud the Said Sume of five pounds thirteen Shills and four pence half penny hath not paid or any ways made Content for the Same (altho’ to do the Same the Said Deft the fourth day of November in the Year afd at the parish County ahd Jurisdiciõn afd by the Said Plt hath been thereto required) but to pay the Same hath hitherto gainsayed and — Still doth gainsay to the damage of the Said Plt tenn pounds Currant money of Maryland and thereupon he brings Sute &ca ——— Jno Doe Johnson pr p:l plds Richd Roe Mr |
