16 March Court 1717 return of Said writ came William Ringgold Gent: one of the Coroners of Kent County and made return thereof in these words thereon Endorsed as folls vizt. Non Est Inventus pr Simon Wilmer Sherf —— And A Decln being fild in Said Accõn and a Copy thereof Expressing the true cause of Accõn being left at the last place of Said Deft~ according to Act of Assembly in Such Case made was as followeth vizt. Kent County Ss Charles Glover of Kent County — Gent~. Stands Attached to Answer unto Simon Wilmer of a plea of Trespass on the Case And Whereupon the afd Plt by Thomas Bowne his attry . Complains for that Whereas the afd Deft~. vizt. the Twenty Second day of August in the Year of our Lord Christ one Thousand Seven hundred and Seventeen at St. Pauls Parish in Kent County within the Jurisdiciõn of this Court had Accounted with the afd Plt. of and Concerning Divers Sumes of Money to the Same Plt. by the afd Deft~ before that time owing and^hithertounpaid and upon that accounting he the Said Deft then and there was found in— arrearage to the Said Plt~ in the Sume of three pounds Seven Shillings and Eleaven pence Currant Silver money of Maryland and So being found in Arrearage the afd Deft~ In Consideration thereof afterwards vizt. the afd - Twenty Second day of August in the year afd at the Parish County & Jurisdiciõn afd upon himselfe assumed and to the Said Plt then and there last mentioned faithfully promised that he the Said Deft~ the afd Sume of Three pounds Seven Shillings and Eleven pence Currant Silver Money of Maryland to the Said Plt. when thereunto — required would well and truly pay & Content and that whereas also the afd Deft~ afterwards vizt the afd Twenty Second day of August in the Year afd at the Parish County and Jurisdiciõn afd was Indebted unto the Said Plt~ in the Sum of three pounds Seven Shillings and Eleven pence for the like Sume of Money by the afd Deft to ye use & behoofe of ye afd Plt. before that time had & Recd . and So thereof being Indebted the afd Deft~. In Consideration thereof afterwards vizt. the afd Twenty Second day of August in the Year afd at the Parish County and Jurisdiciõn afd upon himselfe assumed & to the Said plt~ then and there last mentioned faithfully promised that he the Said Deft. the afd Sume of Three Pounds Seven Shillings and Eleven pence Currant Silver money of Maryland to the Said Plt~. when thereunto required would well and truly pay & Content~ — Nevertheless the afd Deft~ his Severall promises & assumptions afd in forme afd made litle minding but plotting & fraudulently Intending him the Sd Plt~. in that behalfe Crafitly & Subtilly to deceive and defraud the afd Severall Sums of money in the whole amounting unto the Sume of Six pounds . fifteen Shills. and tenn pence Currant^Silvermoney of Maryland to the Said Plt~. altho’ afterwards vizt. the Twenty Second day of September in the year afd & often after at the parish County and Jurisdiciõn afd by the Said Plt~ was — thereunto required hath not paid nor made Content for the Same but that~ |
