body before his Said Lord Ships Justices of the next Court to be held for Said County at the Court house in the Town of Chester in Said County to answer unto Gilbert Higginson of a plea that he render the Summe of Eleven hundred & Thirty two pounds of Pickt & Culd Tobo. of the value of Eleven pounds Sterling which from him he unjustly detains &ca. And that he have then and there the Said writ &ca Att which Said next Court vizt. the Nineteenth day of August the Same Year last mentioned the day of return of Said writ came Simon Wilmer Gent high Sherf of Said County and made return thereof in these words thereon Endorsed as folls vizt Cepi Corpus pr Simon Wilmer Sherf and a Decln being fild in Said Accõn folls vizt Kent County Ss Abram Taylor of Kent Island in Queen Annes County Planter alis Dics Abram Taylor of Kent Island in Queen Anns County Planter was Summoned to Answer unto Gilbert Higginson of a plea that he render him the Summe of Eleven pounds Sterling money which from him he unjustly detains &ca. and whereupon the afd Plt by Thomas Bowne his attorney Saith that whereas the afd Deft the thirtieth day of June in the Year of our Lord Christ one Thousand Seven hundred and Sixteen at St. Pauls. Parish in Kent County within the Jurisdiccon of this Court by his Certain bill obligatory which he the Said Deft Sealed with his Seal and as his deed Delivered hereinto Court brought the date whereof is the Same day and Year afd bound himselfe to pay to the Said Plt or his Lawfull Attorney the Sume of Eleven hundred and thirty two pounds of Pickt and Culed Tobacco to be paid in the County afd in his Caske to his liking of the value of Eleven pounds Sterling money at or before the tenth day of 8.ber next Ensuing the date of the afd Bill obligatory Yet the afd Deft alth often required the afd Eleven hundred thirty and two pounds of Pickt and Culed Tobacco of the afd value to the Said Plt hath not paid but that to him to render or pay the said Deft hath hitherto denied and Yet doth deny to the damage of the Said Plt Twenty pounds Sterling money and thereupon he brings Sute &ca TBowne pr Quer plds Jno Doe Richd Roe and the afd Plt. by his afd attry pray that he may be taken as Surety for Cost the Plt not living in the County which is granted And that the afd Thomas Bowne acknowledges himselfe Surety for the afd Plt: in the afd Accõn and doth under take to pay all Cost in the afd Accõn for the afd Plt if the Said Deft Shall appear to the Same and Cast the Plt in the Same and the Plt. Shall not pay ye Cost himselfe and the afd Deft. being called came And the Said Plt. by his afd attry prays that the Said Deft. may give Speciall baile to the afd Accõn which was granted And that he be kept in Safe Custody by the Sherf of Said County untill he Should give Speciall bail After which Thomas Hynson and Charles Hynson both of Said County comes into Court and Acknowledges themselves Joyntly and Severally Special bail in the afd Accõn and they and either of them do undertake for the afd Deft the payment of the debt afd and Cost thereon accruing if the Said Deft Shall be cast in the Same and the Condemnation Shall not Satisfie nor himselfe to the Custody of the Sherrife of Said County deliver or that they the Said Thomas Hynson and Charles Hynson or either of them the body of the Said Deft Shall not render &ca. and |
