August Court 1718 145 endorsed as folls vizt. Cepi Corpus pr Simon Wilmer Sherf and a Declaration being fild in Said Accon which folls vizt. Kent County Ss Thomas Masay of Kent County planter was attached to Answer unto John Johnson & Isabella his wife of a plea of Trespass on the Case and Whereupon the afd Plts by Thomas Bowne their Attorney Complains that Whereas the afd Deft the Twenty first day of Aprill in— the Year of our Lord Christ one Thousand Seven hundred and Eighteen at St. Pauls Parish in Kent County within the Jurisdiciõn of this Court was Indebted unto the Said Plts in the Sume of five hundred and Sixty pounds of Tobacco for the like Sume of Tobacco by the afd Deft of The afd Plts before that time had and received and So thereof being Indebted the afd Deft In Consideration thereof then and there upon himselfe assumed and to the Said Plts then and there faithfully promised that he the Said Deft the afd Sume of five hundred & Sixty pounds of Tobacco unto the Said Plt. when thereunto required would well & truly pay and Content Nevertheless the afd Deft. his promise and assumption afd In forme afd made little regarding but plotting & fraudulently Intending them the Said Plts in that behalf Craftily and Subtilly to deceive and defraud the afd Sume of five hundred and Sixty pounds of Tobacco to the Said Plts altho he the Said Deft afterwards vizt. the Twenty first day of May in the Year afd and often after at the parish County and Jurisdiciõn afd was thereunto required — hath not paid nor made Content for the Same But that [illegible] to pay or make Content for the Same hitherto hath denyed & Still doth Deny to the damage of them the Said Plts One Thousand pounds of Tobacco & thereupon they bring Sute &ca TBowne pr Quer plds Jno Doe & Richard Roe and the afd Deft. in his proper person appeared to the afd Accon and Saith that he Cannot gainsay the Accon afd of the Said Plts nor but that he is indebted to the Said Plts the afd Sume of five hundred and Sixty pounds of Tobacco and is willing that Judgment Should be entred for the Same and Cost thereon Accruing Therefore it is Con: :sidered by the Court here vizt. this Twenty Second day of August Anno Domini One Thousand Seven hundred and Eighteen That. the afd Plts John Johnson and Isabella his wife do Recover against the Said Deft. Thomas Masay as well the afd Sume of five hundred - and Sixty pounds of Tobacco Damages as also the Sume of Two — hundred and thirty pounds of Tobacco Cost by the afd Plts about. their Sute in this behalfe Expended and by the Court here of their assent adjudged and the Said Deft in mercy &ca Jams Smith Clk |
