August Court 1718 143 Michael Byrne at the Same time as afd Entered into Recognizance in the Sume of five pounds Sterling to be Leveyd &ca Conditionally that if the afd Thomas Hughs did not appear at this Court as an Evide for his Siad Lord Ship against the afd Thomas Cooke This Court here discharges him from the Said Recognizance
the County afd & within the Jurisdiciõn of this Court by force and Armes the Tobacco house of a certain William Pope then and there did break & enter & the quantity of Ninety Six pounds of Tobacco of the value of Sixteen Shillings Sterling the goods & Chattells of the Said William Pope then & there being found then and there feloniously did Steal take & bear away against the peace of our Said Lord Proprietor his Rule & dignity & that Whereas a Certain Thomas Cooke late of Eastern neck Hundred in the County afd Labourer the Said tenth day of May in the Year afd at Eastern Neck Hundred afd & at divers days & times before the Said felony in forme afd made & perpetrated at Eastern Neck Hundred afd in the County afd maliciously & feloniously did Counsell command procure incite & abett the afd Robert Lynch the afd felony volunta: :rily to do & Committ against the peace of our Said Lord Proprietor his Rule & dignity & against the forme & effect of an Act of assembly of this Province now in force in Such Case made & provided Johnson pr Dno Proprietor on the back of the preceeding Indictment was Endorsed as folls vizt. Billa vera pr. Abram. Redgrave foreman Evide Thomas Hughes Tim Slauter and the afd Thomas Cooke in his proper person appeared to the afd Indictment and pleads as folls vizt. The afd Thomas Cooke Says he is not guilty of the premises as afd layd against him and for tryall puts himself on God & the Country Tho Cooke in pr person and he who follows for the Lord propry in like manner Johnson pr Dno prpry And thereupon the Same was Continued untill the then next Court at which Said next Court vizt. this Twenty Second day of August Anno Domi one Thousand Seven hundred and Eighteen The Same Cause Standing for Tryall came the afd Thomas Cooke in proper person and the afd Clark of Indictments who prosecutes for his Lord Ship And the afd Thomas Cooke Stands at the barr and prays Tryall in the afd Cause and That Thomas Bowne |
