14 March Court 1717 the afd Plts by Thomas Bowne their Attry. Complaineth that whereas the afd Deft~ the Twelth day of October in the Year of our Lord Christ one Thousand Seven hundred and Seventeen at St. Pauls Parish in Kent County within the Jurisdiciõn of this Court In Consideration that the afd Plts. at the Speciall Instance and request of the afd Deft had then and there Sold and delivered unto the afd Deft~. and to the proper use and behoofe of the afd Deft divers goods & Merchandizes in an Accot. hereto Annexed at the Severall rates & prices Specifically Sett forth. in the whole amounting unto the Summe of one Thousand Nine hundred and. Twenty Six pounds of Merchantable Tobacco upon himselfe assumed and to the Said Plts. then and there faithfully Promised that he the Said Deft~ the afd Sume of One Thousand Nine hundred & Twenty Six pounds of Merchantable Tobacco unto the Said Plts. when thereunto required would well and truly pay & Content~ and that Whereas also the afd Deft afterwards vizt. the afd Twelfth day of October in the Year afd at the Parish County & Jurisdiciõn afd In Consider: :tion that the Plts. at the like Speciall Instance & request of the afd Deft~ had then and there last mentioned Sold and delivered unto the afd Deft~ and to the proper use and behoofe of the afd Deft~ divers goods and Merchandizes as in Said Accot. hereunto Annexed Specifically Set forth upon himselfe assumed and to . the Said Plts. then and there last Said faithfully promised that he the Said Deft~ So much Merchantable Tobacco as the afd last mentioned Goods & Merchandizes Sold & delivered as afd at the time of the Sale and Delivery thereof at reasonable rates and prices were worth and Amounted to unto the Said Plts. when thereunto required would well & truly pay & Content~ and the afd Plts — Indeed Saith that the afd last mentioned Goods and Merchandizes Sold and delivered as last Said at the time of the Sale and delivery thereof at reason: :able rates & prices were worth and amounted unto the Sume of one — Thousand Nine hundred and Twenty Six pounds of Merchantable Tobacco in Manner as in said Accot. Sett forth of which the Said Deft~ then and there last mentioned had notice Nevertheless the afd Deft~ his Severall promises & assumptions afd in forme afd made litle minding but fraudulently Intending them the Said Plts. in that behalfe Craftily & Subtilly to deceive & defraud ye. afd Severall Sumes of Tobo. in the whole amounting unto the Sume of Three Thousand Eight hundred & fifty Two pounds of Merchantable Tobacco to the Said Plts or to either of them hath not paid nor made Content for the Same altho’ afterwards vizt. the Twentieth day of November in — the Year afd & often after at the parish County & Jurisdiciõn afd he the Said Deft~. by the afd Plts was thereunto required But the afd Sume of Three Thousand — Eight hundred fifty Two pounds of Tobacco to the Said Plts. or to either of — them to pay or Content for the Same hitherto hath denied & Still doth— deney to the damage of the Said Plts.
