   ye value of one Thousand Pounds of Tobo. and thereupon he brings Sute &ca.
                                                                            Johnson pr Plt~. Plds Jno Doe Rd Ro[e]
   and the Said Deft~ being called came and the Said Plt~ by his afd attry prays that the Sd
   Deft~ may give Special baile to the afd Accõn which was granted And that he be
   kept in Safe Custody by the Sherf of Said County untill he Shall give Special baile
   as afd      After which William Debruler of Said County here in Court cometh.
   and Acknowledges himselfe Special baile in the afd Accõn and doth undertake
   for the Said Deft~. the payment of the Damages afd & Cost Accruing if in Case~
   the Said Plt. Shall obtaine Judgment in the Said Accõn of Trespass of the Case~
   and the Said Deft~ the Condemnation Shall not Satisfie nor himselfe to the
   Custody of the Sherf of Said County deliver or that the afd William Debruler
   the body of the Said Deft~ Shall not render &ca— and the Said Deft~ Saith
   that he Cannot gainsay the Accõn afd of him the Said Plt. nor but that he did
   assume to pay to the afd Plt. the afd Sume of five hundred pounds of Tobacco
   and is willing that Judgment~. Should be entered for the Same and Cost thereon
   accruing Therefore it is Considered by the Court here vizt. this Twentieth day
   of March Annoq Domini One Thousand Seven hundred and Seventeen—
   That the afd Plt. John Moll do recover against~ the Said Deft~. William Powell
   as well the afd Sume of five hundred pounds of Tobacco Damages on Accot.
   of the Said Deft not performing his Promise and Assumption afd and also
   the Sume of Three hundred and Seventy three pounds of Tobacco Cost by
   the afd Plt. about his Suite in this behalfe Expended and by the Court here
   of his assent adjudged and the Said Deft in mercy &ca

   James Smith & | Commanded it was to the Sherf of Kent County the Twenty
   Richard Bennett | third day of November in the Second Year of his Lordships
           at | Dominion &ca. That he take Charles Glover late of Kent~
   Charles Glover | County Gent~ if he Should be found in his Bailywick &

him Safe keep So that he have his body before his Said
   Ships Justices of the next Court to be held at our Court house in the Town of Chester
   in Said County to Answer unto James Smith and Richard Bennett in Company of
   a plea of Trespass of the Case and that he have then and there the Said writ~
   &ca. .   Att which Said next Court vizt. the Eighteenth day of March the Same
   year last mentioned the day of return of Said writ came Simon Wilmer Gent~.
   high Sherf. of Said County and made return thereof in these words thereon——
   endorsed as folls vizt. Non Est~. Inventus pr Simon Wilmer   And a Decln.
   being fild in the above Accon and a Copy thereof Expressing the true cause
   of Accon being left~ at the last place of the Said Deft~. according to Act~ of~
   Assembly in Such case made was as folls vizt. Kent County Ss Charles Glover
   late of Kent County Gent~. Stands attached to answer unto James Smith and
   Richard Bennett in Company of a plea of Trespass of the Case And Whereupon
