130 August Court 1718 agreed upon himselfe assumed and to the Said Benjamin then and there faithfully promised that he the Said Richard all Such Sumes of Tobacco as the afd Benjamin had Expended or laid out in and about the Said Sute Together with the Said Two Thousand five hundred and Eighty pounds of Tobacco after he the Said Benjamin Should have proved the Said Two Thousand five hundred and Eighty pounds of Tobacco to the Said Benjamin when thereunto required would well and truely pay and Content and the afd Benjamin Indeed Saith that the Tobacco he the Said Benjamin had Expended and laid out in and about the Said Sute amounted unto the Sume of One hundred and Seventy pounds of Tobacco and that he the Said Benjamin afterwards vizt. the Twenty Second day of March in the Year of our Lord Christ One Thousand Seven hundred and Sixteen at Chester Town in Kent County afd in the Court afd in Open Court before the afd Justices in the Said Court Judicially Sitting in the Records of— the Same Court did Cause the Said Accõn to be Entered agreed as by the Records of the Same Court here remaining fully appears of all which Two Thousand five hundred and Eighty pounds of Tobacco proved as afd and One hundred and Seventy pounds of Tobacco Cost of Sute the Said Richard by the afd Benjamin afterwards vizt the afd Twenty Second day of March in the Year afd at St. Pauls parish in Kent County afd within the Jurisdiciõn of this Court had Notice and that whereas also the afd Deft afterwards vizt. the afd Twenty Second day of March in the Year of our Lord Christ One Thousand Seven hundred and Sixteen at St. Pauls Parish in Kent County afd within the Jurisdiciõn of this Court was Indebted unto the Said Plt. in the Sume of One hundred and Seventy pounds of Tobacco a Certain Cost of Sute and the Sume of Two Thousand five hundred and Eighty pounds of Tobacco for divers Services done by the afd Plt. for the afd Deft. and to the and Jurisdiciõn afd done & performed and So thereof being Indebted the afd Deft In Consideration thereof upon himselfe assumed and to the Said Benjamin then and there^last Saidfaithfully promised that he the Said Deft the afd Sume of one hundred and Seventy pounds of Tobacco and So much Tobacco due for the — Services done and performed as last mentioned as upon proof Should appear to the Said Plt. to be due to him the Said Plt. when thereunto required would well and truly pay and Content And the afd Plt Indeed Saith that the afd Twenty Second day of March in the year afd the Summe of Two Thousand five hundred and Eighty pounds of Tobacco as by the Oath of the Said Plt before Nathaniel Hynson and his associates then Justices of the Right Honourable the Lord Proprietor for the Said Court in the Said Court in the County and Jurisdiciõn afd Judicially Sitting taken was Legally proved and appeared due to the Said Plt. as by the Records of the Same Court here Remaining fully appears and of which the Said Deft the Twenty third day of March in the Year afd at the Parish County & Jurisidicõn afd had notice And that Whereas also the afd Deft afterwards vizt. the afd Twenty Second day of March in the Year afd at the Parish County and Jurisdiciõn afd was Indebted unto the afd Plt in the Sume of Two Thousand five hundred and Eighty |
