128 August Court 1718 the within named Christopher Philipson to Satisfie unto the within Specified Jedidiah Andrews the within mentioned Debt and Cost and that they the Said Daniel Pearce & Thomas Cooke are to be and appear at the time and place within mentioned to Shew cause if any they have why Judgment Shall not goe against them for the debt & Cost within Mentioned to Satisfie to the within Specified Jedidiah Andrews the debt and Cost within mentioned as also made known to the Same to the Said Daniel Pearce before Michael Hacket and Isaac Caulk and to the Said Thomas Cooke before Abraham Ambrose and Owen Whaland and have also Sumoned the Said Daniel Pearce and Thomas Cooke that they be and appear at the time and place within mentioned to Shew cause why Judgment Should not go against them as the Special baile of the within mentioned Christopher Philipson to Satisfie to ye within mentioned Jedidiah Andrews the debt & Cost as within mentioned as the within writ Exacteth & requireth pr me S:Wilmer Sherf and the afd Defts Daniel Pearce and Thomas Cooke by Thomas Bowne And James Earle their attorneys came and defended the force and Injury &ca. And Saving to themselves all manner of Advantages and Exceptions to the writ afd prays liberty to imparle thereto and to answer at next Court which was granted the Same day was given the Plt in like manner also Att which Said next Court vizt. the nineteenth day of November the Same Year last mentioned the Same cause was Continued untill the then next Court Att which Said next Court vizt. the Eighteenth day of March the Same year last mentioned the Same cause was Continued untill the then next Court Att which Said next Court vizt. the Seventeenth day of June Annow Domini One Thousand Seven hundred and Eighteen the Same cause was Continued untill the then next Court Att which Said next Court viz the nineteenth day of August the Same Year last mentioned the Same cause Standing for Tryall Came the afd Plt by John Johnson his attry. and the afd Daniel Pearce and Thomas Cooke by Thomas Bowne and Michael Howard their attrys and A Demurer being filed by the afd Defts attrys in order for a hearing but at the day afd last mentioned Came the afd Defts by their attrys afd and withdrew their Demurer And Saith that they are not Informed what to plead to the Sire facias So as afd brought &ca. whereby the afd Plt may Still remain undefended Therefore it is Considered by the Court here vizt. this twenty first day of August the Same Year last mentioned That the afd Jedidiah Andrews have a |
