August Court 1718 121 you that by good and Lawfull men of your Bailywick you make known unto the Said Benjamin Griffiths that he be and appear before the Justices of our next County Court to be held at our Court house in the Town of Chester in Said County on the third tuesday in August next to Shew Cause if any he have why Execution Shall not Issue forth against him for the debt and Cost in the Judgment afd — Specified And how you Shall Execute this writ that you make known unto the Justices of our Said Court at the day and place afd hereof you are not to faile at your perill And have you then and there the names of the - persons before whom you Shall make the Same known and this writ Witness Nathaniel Hynson Gent chiefe Justice of our Said Court this Nineteenth day of June in the fourth Year of our Dominion &ca. Anno Domi 1718 TBowne pr q.rs JamsSmith Clk Att which Said next Court vizt. the Nineteenth day of August the Same Year last mentioned the day of return of Said writ Came Simon Wilmer Gent high Sherf of Said County and made return thereof in these words thereon Endorsed as folls vizt. By vertue of the within Writ to me Directed These are to Certifie to the Justices within mentioned that I have made known to the within named Benjamin Griffiths that he be and appear at the time place within — mentioned and then and there to Shew cause if any he hath why Execution Shall not Issue forth against him for the debt and Cost in the Judgment within mentioned before William Howard & Eliza. his wife good and Lawfull men of my Balwick and So Answers Simon Wilmer Sherf and the afd Plt. by Thomas Bowne his attry came into Court and prayd that the Said Deft might Answer as afd And the afd Deft being Solemnly called came not on which it is ordered that Judgment be Entered agst the afd Deft- for the debt in Siri facias afd & Cost therein mentioned if not cause is Shewn to the Contrary during the Court Sitting And now at this time the afd Deft being — Solemnly called came not whereby the afd Plts may remain undefended Therefore it is Considered by the Court here vizt. This Twenty first day of August Anno Domini One Thousand Seven hundred and Eighteen That the afd Plts Richard Smithers and Mary his wife Executrix of the afd John Carvell deceased for the afd Sume of Twelve hundred pounds of Tobacco the Debt afd as also the Sume of Three hundred Twenty four pounds of Tobacco Cost in the afd Siri facias mentioned Amounting in the whole to the Sume of ffifteen hundred twenty four pounds of Tobacco as also the Sume of Two hundred thirty three pounds of Tobacco Cost about the afd Sire facias in this behalfe Expended and by the Court of there assent adjudged And that the afd Plts have an Execution agst. the afd Benjamin Griffiths for the Sumes afd Jams Smith Clk |
