     120                                    August Court 1718
   Selves joyntly and Severally Special baile in the above accõn and they &
   each of them do undertake for the afd Deft the payment of the Debt afd and
   Cost thereon accruing if the afd Deft Should be Cast in the Same And the
   Condemnation afd Shall not Satisfie nor himselfe to the Custody of the Sherf.
   of Said County deliver or that the afd John Brown and James Reyley or either
   of them the body of the afd Deft Shall not render &ca ———
   and the afd Deft in his proper person appeared to the afd Accõ and
   Saith that he Cannot gainsay the Accõn afd of him the Said Plt nor
   but that the writing obligatory above mentioned is his Act and
   deed and that he oweth unto the afd Plt. the afd Sume of Seven—
   hundred and Eighty pounds of Tobacco and is willing that Judgment
   Should be Entered for the Same and Cost thereon accruing Therefore
   it is Considered by the Court here vizt. this Twenty first day of August
   Annoq Domini One Thousand Seven hundred and Eighteen That the
   afd Plt James Heath Recover against the Said Deft Henry Chanell
   as well the afd Sume of Seven hundred and Eighty pounds of Tobacco
   the Debt afd as also the Sume of Three hundred and two pounds of—
   Tobacco Cost by the afd Plt about his Sute in this behalfe Expended &
   by the Court here of his assent adjudged and the Said Deft in mercy &ca.

a Court held at our Court house in the Town
   of Chester in Said County on the Twenty third day of March in the Year of
   our Lord Christ one Thousand Seven hundred and Sixteen before Edward Scott
   Gent. and his associates then Justices of the peace for our Said Lord proprietarie
   for the County afd in Court Judicially Sitting then held for Kent County afd in a
   Cause then and there depending Between Richard Smithers and Mary his
   wife late called Mary Carvill Exrx. of the last will & Testament of John
   Carvill late of Sd County Gent deceased Plts And Benjamin Griffiths of Kent
   County Taylor alis Dics Benjamin Griffith of Kent County in the Province of
   Maryland Taylor Deft. the Said Plts Recovered Judgment against the Said
   Deft as well for the Sume of one Thousand two hundred pounds of Tobacco
   Debt whereof he is convict as appears upon Record as also the Sume of
   Three hundred twenty four pounds of Tobacco Cost of Sute and for that
   Satisfaciõn hath not thereupon Yet been made wee Therefore Command
