August Court 1718 115 late called Elizabeth Bateman Executrix of the last will and Testament of William Bateman late of Kent County Planter Deceased if they Should be found in his Bailywick and them Safe keep So that he have their bodys before his Said Lord Ships Justices of the next Court to be held at our Court house in the Town of Chester in Said County to Anser unto Thomas Smyth of a plea of Trespass upon the Case - and that he have then and there the Said writ &ca. Att which Said next Court vizt. the Nineteenth day of August the Same Year last mentioned the day of return of Said writ Came Simon Wilmer Gent high Sherf of Said County and made return thereof in these words thereon Endorsed as folls vizt. Cepi Corpus pr S:Wilmer Sherf. And A Declaration being filed when Said writ Issued forth & Copy thereof Served therewith according to Act of Assembly in Such Case made was as folls vizt. Kent County Ss. Nathaniell Ricketts of Kent County Planter and Elizabeth his wife late called Elizabeth Bateman Executrix of the last Will and Testament of William Bateman late of Kent County Planter Deceased Stands Attached to Answer unto . Thomas Smyth of a plea of Trespass upon the Case And Whereupon the afd Plt. by Thomas Bowne his attry Complaineth that Whereas the afd Testator in his life time vizt. the Twenty fifth day of January in the year of our Lord Christ one Thousand Seven hundred and Eleven at St. Pauls Parish in Kent County within the Jurisdicion of this Court In Consideration that the afd Plt. at the Speciall Instance and request of the afd Testator had then and there^inthe life time of the Said Testator Sold and delivered unto the afd Testator and to the proper use and behoofe of the afd Testator divers Goods and Merchandizes in an Accot. hereto Annexed Shewn then and there upon himselfe assumed and to the Said Plt. then and there faithfully Promised that he the Said Testator So muhc Merchantable Tobacco as the afd Goods and Merchandizes Sold & delivered as afd at the time of the Sale and delivery thereof at reasonable rates and prices were worth and amounted to unto the Said Plt when thereunto required would well and truly pay and Content and the afd Plt Indeed Saith that the afd Goods and Merchandizes Sold and delivered as afd at the time of the Sale and delivery thereof at Reasonable Rates and prices were worth and Amounted unto the Summe of one hundred & thirty two pounds of Merchantable Tobacco in Manner as in the Said Accot. Sett forth of which the Said Testator in his life time then and there last mentioned had Notice And that Whereas also the afd Testator in his life time afterwards vizt. the afd Twenty fifth day of January in the year afd at the Parish County and Jurisdiciõn afd In Consideration that the afd Plt at the like Special Instance and request of the afd Testator had then & there last mentioned in the life time of the Said Testator done & performed divers Services for the afd Testator and to the proper use and behoofe of the afd Testator as in Accot hereto Annexed Set forth Specifically ap: pears |
