   last mentioned faithfully promised that he the Said Deft the afd Sume of one
   hundred and fifty five pounds of Merchantable Tobacco unto the Said Plt when
   thereunto required would well and truly pay and Content And that Whereas also
   the afd Deft afterwards vizt. the Twenty third day of January in the Year of our
   Lord Christ One Thousand Seven hundred and Sixteen at St. Pauls Parish in Kent
   County within the Jurisdiciõn of this Court was Indebted unto the afd Plt in the Summe
   of Two hundred and fourteen pounds of Merchantable Tobacco for the like Summe
   of Tobacco for one Levy of one Taxable then and there last mentioned due from
   the Said Deft. unto the afd Plt the afd Plt then and there last mentioned being
   Sherife of Said County and So thereof being Indebted the afd Deft In Consideration
   thereof then and there last mentioned upon himselfe assumed and to the Said
   Plt. then and there last mentioned faithfully promised that he the Said Deft
   the afd Sume of Two hundred and Twenty one pounds of Merchantable Tobacco
   unto the Said Plt. when thereunto required would well and truly pay and Content
   Nevertheless the afd Deft. his Promises and Assumptions afd in forme afd made
   as to the afd Severall Sums of Tobacco which in the whole amount unto the
   Sume of five hundred and fourteen pounds of Merchantable Tobacco little —
   regarding but plotting and fraudulently Intending him the Said Plt in that
   behalf craftily and Subtilly to deceive and defraud the afd Sume of five
   hundred and fourteen pounds of Merchantable Tobacco to the Said Plt. altho’
   afterwards vizt. the fifth day of October in the Year of our Lord Christ one Thousand
   Seven hundred and Seventeen and often after at the Parish County and Jurisdiciõn
   afd was thereunto hath not paid nor made Content for the Same but that to
   him to pay or Content for the Same hitherto hath denied and Still doth deny
   to the damage of him the Said Plt one Thousand and Twenty Eight pounds
   of Merchantable Tobacco and thereupon he brings Sute &ca.                   Jno Doe

   and the afd Deft. in his proper person appeared to the above Accon and Saith
   that he Cannot gainsay the Accõn afd nor but that he oweth unto the Said
   Plt the afd Sume of five hundred and fourteen pounds of Tobacco and is
   willing that Judgment Should be Entered for the Same and Cost thereon
   accruing:    Therefore it is Considered by the Court here vizt. this Twenty
   first day of August Annoq Domini One Thousand Seven hundred and ——
   Eighteen That the afd Plt. William Frisby do Recover against the afd
   Deft William Cock as well the afd Sume of five hundred and fourteen pounds
   of Tobacco Damages as also the Sume of Three hundred and Twenty one
   pounds of Tobacco Cost by the afd Plt about his Sute in this behalfe Expended
   and by the Court here of his assent adjudged and the Said Deft in mercy &ca.
