462 sale of said negroes, and to secure them to Mary T. Wood, wife of said William H. Wood, agreed to loan her the sum of twelve hundred dollars, to satisfy said judgments, provided said William her husband, would secure to her, the said negroes, who had formerly belonged to the Estate of her Father, Robert Garner deceased, said loan to be secured to them, by a mortgage on her real estate. And whereas in furtherance of said agreement, said one James Ward advanced the sum of six hundred dollars, Richard L. Griffith, one hundred dollars and Floyd Chaney five hundred dollars, and said sums of money having been secured by mortgage on her interest, in her said Father's real estate, as by mortgage, intended to bear even date with these presents, and recorded among the records of Anne Arundel County, will appear, and the said money having been applied in payment of said Judgments and Executions, the said William H Wood, in accordance with said agreement, is willing to execute these presents. Now therefore this Indenture witnesseth, that for and in consideration of the premises, and for the further consideration of the sum of five dollars, current money to him in hand, well and truly paid by the said Floyd Chaney at and before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged, the said William H. Wood has granted, bargained and sold, and by these presents doth grant, bargain and sell unto the said Floyed Chaney his Executors Administrators and assigns, all and singular the following negroes, slaves for life, to wit: Ann about the age of thirty five years, and her six children, to wit: Tom, Joe, Celia, Henry, Elisa, Ellen, and an infant now in the possession of the said William H. Wood. To have and to hold, all and singular, the said named negro slaves, and their increase, and each and every of them, above bargained and sold, or mentioned and intended so to be, to the said Floyd Chaney, his Executors, Administrators and Assigns forever, in trust nevertheless, for the sole and separate use of the said Mary T. Wood wife of the said William H Wood, during her natural life, and so that she may have and enjoy the aforesaid negroes, and receive and take the rent or hires and profits thereof in the same manner as if she were a feme-sole, notwithstanding her present or any future coverture, and without any liability to and for the debts of her present, or any future husband, with full power and authority for the said Mary T. Wood, to hire, sell, or otherwise dispose of the same, or any of them, at her own will |
