have advanced to the same William Lomax the sum of two hundred
dollars Current money and whereas it is the wish of the said William
Lomax to secure to the said Thomas J. Hall & son the payment of the said
sum of two hundred dollars current advanced as aforesaid and for that
purpose the said William Lomax hath agreed to execute these presents
Now this Indenture witnesseth that the said William Lomax for and in
consideration of the premises and for and in consideration of the sum of five
dollars current money to him in hand paid by the said Thomas J. Hall & son
at or before the sealing and delivery of these presents the receipt whereof the said
William Lomax doth hereby acknowledge and thereof and therefrom doth
acquit release and exonerate and forever discharge the said Thomas J. Hall & son
their executors administrators and assigns and every of them by these presents
hath granted bargained and sold and by these presents doth grant bargain
and sell unto the said Thomas J. Hall & son their executors administrators and
assigns all and singular the following property to wit one gray Horse 8 years old
one Bay horse 6 years old three milch cows two calves one sow and ten shoats
fifty Barrells of corn together with all his interest in and to the Crop of tobacco
raised on the Land of Henry Lyles late of Anne Arundel County dec.sd in Eighteen
hundred & forty four and now in the Tobacco Houses on said Land the said interest
being one third part thereof the other property above is in my possession.  To
have and to hold all and singular the said property herein before granted
bargained and sold or mentioned or intended so to be unto the said Thomas J
Hall & son their executors administrators or assigns to the only proper use
and behoof of the said Thomas J. Hall & son their executors administrators
and assigns forever  Provided always and these presents are upon this
condition that if the said William Lomax his executors or administrators
shall and well and truly pay and satisfy the said Thomas J. Hall & Son
the sum of money advanced as aforesaid.  Then and in that case every
matter and thing herein contained shall cease determine and be utterly
void to all intents and purposes any thing herein contained to the contrary
notwithstanding.  And the said William Lomax for himself his heirs
Executors and administrators all and singular the said property by
these presents granted bargained and sold and every part thereof unto the
said Thomas J. Hall and son their Executors administrators and assigns
against him the said William Lomax his executors and administrators
and against all and every person and persons whatsoever shall and will
warrant and forever defend by these presents.  In witness whereof the said
William Lomax hath hereunto subscribed his name and affixed his seal the
day and year first herein before written
