5 On the back of the aforegoing was thus written to wit: On this eleventh day of February in the year eighteen hundred and forty four appeared the within named William Lomax before me the Subscriber a justice of the peace of the State of Maryland in and for Anne Arundel County aforesaid and acknowledged the within instrument of writing to be his act and deed for the purposes therein mentioned Acknowledged before Chas Hodges Recorded the 28.th day of February 1845 Know all men by these presents that I Caleb White of Anne Arundel County and state of maryland for and in consideration of the sum of six hundred and twenty dollars to me in hand paid by Daniel Duvall and Thomas R. Beard of the County and state aforesaid before the sealing and delivery of these presents the receipt whereof I the said Caleb White do hereby acknowledge have granted bargained and sold and by these presents do grant bargain and sell unto the said Daniel Duvall and Thomas R. Beard their executors administrators and assigns one negro man named Margaret one negro boy named Osborn one small negro Girl named Ann all of which is now in my possession to have and to hold the said described property to the said Daniel Duvall and Thomas R. Beard their executors administrators and assigns all and every person or persons whomsoever shall and will warrant and forever defend by these presents provided nevertheless that in case I the said Caleb White shall pay and satisfy the said Danl Duvall and Thomas R. Beard or to their executors administrators and assigns the sum of six hundred and twenty dollars with interest for the same on or before the first day of July one thousand eight hundred and forty six then this bill of sale and every matter and thing therein expressed shall be void and of no effect it being the true intent and meaning that the said property is mortgaged by me the said Caleb White to secure the said Danl Duvall and Thos R. Beard the payment of the money aforesaid in witness whereof I the said Caleb White have hereunto set my hand and affixed my seal Caleb White (seal) On the back of the aforegoing was thus written to wit Maryland Anne Arundel County Sct On this 13.th day of February 1845 before one of the Justices of the peace in and for the said County appears Caleb White and acknowledges the within instrument of writing to be his act & deed according to the true intent and meaning thereof and the act of Assembly in such case made and provided Witness my hand Geo A. Barber Paid Recorded the 19.th day of February 1845 |
