399 five as by reference to the Last will and testament of Edward Williams in the office of the Register of Wills of Anne Arundel County will more fully appear To have and To Hold the said negro "Tom" above bargained and sold or meant mentioned and intended so to be unto the said John N Stewart his executors administrators and assigns to his and their own proper use and behoof provided and it is declared to be the true intent and meaning of these presents that if the said Edward C Williams do and shall well and truly pay or cause to be paid unto the said John N Stewart his executors administrators or assigns the full sum of three hundred and fifty dollars Current money with legal interest for the same from the date of these presents on or before the twentieth day of February in the Year Eighteen hundred and fifty one then and in such Case these presents and every matter and thing therein contained shall cease determine and be utterly null and void to all intents and purposes any thing herein contained to the contrary thereof in any wise notwithstanding And the said Edward C Williams for himself his executors and administrators and for every of them doth covenant grant promise and agree to and with the said John N Stewart his executors and administrators and assigns that he the said Edward C Williams his heirs executors or administrators shall and will well and truly pay or cause to be paid unto the said John N Stewart his executors administrators or assigns the sum of three hundred and fifty dollars current money together with Interest for the same at such time and after such manner as is herein before set forth and agreed upon for the payment of the same In Witness whereof the said Edward C Williams and John N Stewart have hereunto interchangeable set their hands and affixed their seals on the day and year first hereinbefore written Signed sealed and delivered in presence of Edward C Williams (seal) Owen M Taylor John N Stewart (seal) Anne Arundel County to wit On this twentieth day of February in the year Eighteen hundred and fifty personally appeared the said Edward C Williams and John N Stewart parties to aforegoing deed or Instrument of writing before me the subscriber a Justice of the peace in and for Anne Arundel County and acknowledged the same to be their act ad deed for the purposes therein mentioned also at the Same time and place John N Stewart party grantee made oath on the Holy Evangely of Almighty God that the consideration therein set forth is true and Bona fide as therein Stated Acknowleged and sworn before Owen M Taylor J P Recorded on the 9th day of March 1850 Examnd and delivered to Jno N Stewart 4.th March 1851 Cost $1.23 |
