378 serve ten years and Dick about twelve years to serve twelve years and Betsey aged about five years a slave for life. To Have and to Hold all and singular the said negroes hereinbefore granted or mentioned or intended so to be unto the said Johns his executors administrators and assigns to the only proper use and behoof of the said Johns his executors administrators and assigns forever Provided always and these presents are upon this condition that if the said Somervill his executors or administrators shall and do well and truly pay or cause to be paid unto the said Johns his executors administrators or assigns the aforesaid judgment with costs on or before the first day of January eighteen hundred and fifty and also the aforesaid instalments of one thousand dollars each the first on or before the first day of July eighteen hundred and fifty the second on or before the first day of July eighteen hundred and fifty one and the third on or before the first day of July eighteen hundred and fifty two with legal interest on the whole of the aforesaid debt remaining due and unpaid ^or that at any time may remain due and unpaid^ to be paid seminannually on the first day of January and July in each year then and in such case these presents and every matter and thing herein contained shall cease determine and be utterly void to all intents and purposes anything herein contained to the contrary thereof in anywise notwithstanding. And Provided also that until default shall be made of or in payment of the said judgment and costs and sums of money with interest as aforesaid or some part thereof in breach of the condition and proviso herein before in that behalf contained it shall and may be lawful to and for the said Somervill his heirs executors and administrators to hold and enjoy the said negroes hereby granted and sold or intended so to be and the hires and profits thereof to take and receive to his and their own use without any lawful let suit interruption disturbance claim or demand whatsoever of from or by the said John his heirs or assigns or any person or persons lawfully claiming or to claim by from or under him or them or any of them And the said Somervill for himself his heirs executors administrators doth covenant promise grant and agree to and with the said Johns his executors administrators and assigns in manner and form following that is to say that he the said Somervill his heirs executors or administrators or some of them shall and will well and truly pay or cause to be paid unto the said Johns his executors administrators or assigns the aforesaid judgment and costs and the aforesaid instalments with legal interest as aforesaid at the time hereinbefore respectively limited for the payment thereof without any deduction or abatement whatsoever as aforesaid And that the said Somervill and his heirs shall and will at all times hereafter whenever required thereto by the said Johns his heirs or assigns ^At the proper cost and expense of the said Johns his heirs or assigns^ make do execute and acknowledge such further assurance or assurances deed or deeds conveyance or conveyances devise or devises in the law ^as he the said Johns his heirs or assigns or his or their Counsel Learned in the Law^ may or shall advise devise or require for the more certain and effectual assuring conveying and quieting the possession of the said Johns his heirs and assigns of in and to the said negroes forever.
