375 tin ware carpet and sundry other articles too numerous to mention now in the possession of the said Wingate at the "Free Press Office" in Annapolis together with the subscription list and good will of the said paper known and called by the name of the "Maryland Free Press" To Have and to Hold all and singular the said goods and chattels household stuff and printing materials unto the said Cornelius McLean his executors administrators and assigns to her and their own use and behoof Provided always and it is hereby declared to be the true intent and meaning of these presents that if the said James Wingate do and shall well and truly pay or cause to be paid unto the said Cornelius McLean his executors administrators or assigns the said promissory notes according to their tenor and effect with interest then and in such case these presents and every matter and thing herein contained shall cease determine and be utterly void to all intents and purposes anything herein contained to the contrary notwithstanding And the said James Wingate for himself his executors and administrators and for every of them doth hereby covenant promise and agree to and with the said Cornelius McLean his executors administrators and assigns that he the said James Wingate his executors or administrators shall and will well and truly pay or cause to be paid unto the said Cornelius McLean his executors administrators or assigns the said promissory note according to its tenor and effect with interest as hereinbefore described And it is also understood and agreed that with the consent of the said McLean on writing the said Wingate may sell any part of the said materials for the purpose of procuring new or other materials and that the type and other materials that shall be in that way or any any other way at any time brought into the said printing office for the purpose of the said office and to be used therewith or therefor shall be subject to the operation of these presents in the same manner as the several above described pieces of property now are In Witness whereof the said James Wingate and the said Richard W. Gill have hereunto set their hands and seals on the day and year first hereinbefore written Signed sealed and delivered in presence of the word "their" in the James Wingate (seal) last line of the second page being interlined before execution Edward Dubois R. W. Gill (seal) State of Maryland Anne Arundel County to wit Be it remembered and it is hereby certified that on this thirteenth day of November in the year of our Lord eighteen hundred and forty nine before the subscriber a Justice of the peace of the state of Maryland in and for the County aforesaid personally appeared James Wingate and Richard W. Gill who are known to us of our own knowledge to be the persons named and described as and professing to be the parties grantors in the aforegoing Indenture or instrument of writing and acknowledged the same to be their act and deed In Testimony whereof I have hereunto set my hand and on the day and year above written Acknowledged before Edward Dubois State of Maryland Anne Arundel County sct Be it remembered and it is hereby certified that on the day and year last above written before the subscriber a Justice of the peace of the state of Maryland in and for the County aforesaid personally appeared Richard W Gill and Cornelius McLean who are known to us of our own knowledge to be the persons named and described as and professing to be one of the parties grantors and the party |
